Federal judge María Eugenia Capuchetti was bypassed to decide

whether to open the investigation against Máximo Kirchner

, who was denounced for alleged illicit enrichment and falsification of a public document, as a result of the fact that in her last sworn statement she recorded having assets of 292 million pesos.

The same magistrate - in charge of the court that belonged to Norberto Oyarbide - also has yet to decide whether to reopen the investigation against Cristina Kirchner for alleged illicit enrichment.

The assets of the Kirchner family are once again under investigation.

On the one hand, the increase in her wealth that the former President had during her years in front of the Casa Rosada, and now for the same reason with respect to her son Máximo.

Both files are in the hands of the same magistrate, but in two different courts.

María Eugenia Capuchetti was sworn in in May 2019 as the head of Federal Court 5 that belonged to Norberto Oyarbide, where the controversial file for the assets of the former President had been processed, closed by that judge in record time and in the midst of complaints.

That controversy caused a complaint for its reopening, which Capuchetti now has in her hands to decide on it.

In turn, in court 6 - whose head was the now retired judge Rodolfo Canicoba Corral - the complaint will be investigated for alleged inconsistencies in the sworn statement of Máximo Kirchner.

Last week, Capuchetti was drawn to subrogate for one year court 6 that Rodolfo Canicoba Corral left vacant after retiring.

At the head of that office, she must now decide whether to open the investigation into the fortune of Máximo Kirchner.

Her latest affidavit states that she owns 292 million pesos, distributed in 27 properties (25 of which were inheritance), two vehicles, 3 million dollars and shares in three companies.

The lawyer Silvina Martínez maintains that depending on the valuation of the family businesses, intervened after being suspected of their use for money laundering maneuvers,

the assets of the national deputy would amount to 25 million dollars

CFK's heritage 

It was in Court 5 -when Oyarbide was the incumbent-, for only six months the case for illicit enrichment against Néstor and Cristina Kirchner was open.

The case was closed with the dismissal of both, after

a murky accounting expertise

in which the then accountant of the former presidents participated in the case.

The Kirchners were being investigated because, according to their own affidavits of assets,

their assets had increased 158% in one year

.

Between 2007 and 2008, they went from having assets, cash and companies for 17.8 million pesos to accumulating 46 million pesos. The discussion on how he investigated that file was reopened within the framework of the cause of the bribery notebooks, when

Oyarbide admitted that he acted under pressure from former presidents

He said that of the 28 million pesos that the Kirchners' assets had grown between 2007 and 2008,

some 24.7 million were impossible to justify.

In December 2009, with the dollar at $ 3.81, that figure amounted to almost $ 6.5 million. 

The former Kirchner accountant confessed that during 2008 Néstor Kirchner had sold approximately 13 properties that were transferred to Austral Construcciones - Lázaro Báez's company - and Rudy Ulloa, and not all the deeds were available, some were simple copies ”.
