The Paris Court of Appeal enters into rebellion against the Keeper of the Seals

At the same time, the Union Syndicale des Magistrates demands that Eric Dupond-Moretti withdraw his powers in favor of the Prime Minister.


Unanimously.

The Paris Court of Appeal and its heads of court, its first president, Jean-Michel Hayat and its attorney general, Catherine Champrenault, voted a motion nailing the Keeper of the Seals, Éric Dupond-Moretti, to the pillory.

This motion denounces in particular the

"major conflict of interests in which the Minister of Justice is placed, who questioned the national financial prosecutor"

,

"is alarmed by an outright misuse of procedure"

, accuses the Minister of Justice to

"trample on the democratic principle of the separation of powers for the benefit of strictly private interests"

and calls on the President of the Republic to act.

This particularly virulent motion is added to the 90 and soon 100 motions voted by French courts.

In this context, the Union Syndicale des Magistrates does not intend to let go of the Keeper of the Seals either.

"On October 5, the cabinet of the Minister of Justice contacted the national office of the USM to set up a working meeting with the minister"

, announces its president Céline Parisot, but who warns:

"Prior to any meeting, the note of September 29, relating to the limitation of information feedback is not enough to put an end to the controversy ”

.

"We therefore ask the Minister of Justice to implement article 2-1 of decree n ° 59-178 of January 22, 1959, as amended, relating to the powers of ministers"

, she demands and to quote the text:

"The Minister, who considers that he is in a situation of conflict of interest, informs the Prime Minister in writing, specifying the content of the questions for which he considers that he should not exercise his powers.

A decree determines, accordingly, the powers that the Prime Minister exercises in place of the minister concerned.

The latter refrains from giving instructions to the administrations placed under his authority or at his disposal, which receive their instructions directly from the Prime Minister ”
