The Legislative Council passed the Employment (Amendment) Bill 2019 before its adjournment in July this year, increasing the statutory maternity leave from the current 10 weeks to 14 weeks.

The Secretary for Labour and Welfare Law Chi-kwong said at the time that although the legislative amendment has been passed by the Legislative Council, it still takes time to establish a new four-week maternity leave pay repayment mechanism.

As the Labour Department outsources the relevant work, it is hoped that the time for setting up the reimbursement mechanism can be shortened.

After the statutory maternity leave is extended, eligible employees can take 4 consecutive weeks immediately after the 10-week maternity leave, and maintain the statutory maternity leave pay for the extended maternity leave calculated at 4/5 of the employee’s daily average wage. The additional salary incurred in these 4 weeks will be borne by the government. Employers can apply to the government for the additional salary that needs to be paid, and the relevant amount is capped at 80,000 yuan per person.

Since the government has not formally established a reimbursement system this time, the Labour Department will continue to reimburse employers during this transition period.

It is reported that the government will consult the Labour Advisory Board next Wednesday to seek support from members.
