The Constitutional magistrate Fernando Valdés has presented his resignation this Wednesday before the imminence of the presentation by the Prosecutor's Office of a formal accusation of mistreatment in the family.

The resignation implies that the matter will now remain in the hands of the Majadahonda court in which proceedings were opened, after the arrest of Valdés on August 10, when two witnesses reported that a woman had yelled for "help" from the terrace of his house.

The proceedings became a case against Valdés by decision of the Supreme Court, before which he was listed as a Constitutional magistrate.

The Prosecutor's Office and the Valdés defense have maintained contacts in recent days.

Until now, the Constitutional magistrate rejected an agreement between both parties that went through the recognition of the alleged mistreatment of which he is accused, because he continues to defend his innocence.

Now, he will do so before the Majadahonda court, upon losing the jurisdiction in the Supreme Court.

Valdés' resignation implies that the progressive sector of the court is reduced to three magistrates.

This sector was made up, in addition to Valdés, Juan Antonio Xiol, María Luisa Balaguer and Cándido Conde Pumpido, although the latter, a former State Attorney General, has not signed the individual votes of the previous ones on relevant issues related to the

The resignation of Valdés coincides, on the other hand, with a challenge presented by the

former president

of the Generalitat Carles Puigdemont against the also Constitutional magistrate Antonio Narváez.

If this challenge were successful, the court would be reduced to 10 magistrates to resolve some of the most important appeals they have raised after the Supreme Court ruling that condemned the pro-independence leaders for the crime of sedition.

Valdés would have had to resign along with three other magistrates almost a year ago, last November, when his mandate expired.

The lack of agreement between the political forces has prevented the renewal of the Constitutional Law during this time.

When it occurs, said renewal must entail the departure of the president of the court himself, Juan José González Rivas, as well as that of the vice president, Encarna Roca, and that of magistrate Andrés Ollero.

All of them were appointed in the appointment time that corresponds to Congress.

Hence, the resignation of Valdés has been officially communicated early this afternoon to the president of the Chamber, Meritxell Batet, shortly after concluding a lunch that the aforementioned magistrate shared with the president of the Constitutional Court, to whom he delivered the letter in which he waives to continue in court.
