The Tel Aviv District Court today (Monday) acquitted gynecologist Benny Schechter of two charges of rape fraudulently of patients, but convicted him of three counts of indecent acts of fraud.

He noted that the acts Schechter committed on the patients were not done for his sexual gratification, but went beyond the bounds of legitimate treatment and were done without their consent.

The judges ruled that Schechter exceeded the limits of medical care while taking advantage of the patients' trust in him.



The judges clarified that "the three complainants before us needed treatment after complaining of pain while having sex," wrote Justices Tali Haimovich, Gershon Gontobnik and Avraham Heiman.

They clarified that "in this state of affairs genital contact is acceptable, required and even required."



However, they added, "Still, sexual therapy also has limits. The value of human dignity does not remain outside the walls of the medical clinic. The judges ruled that Schechter's actions did not amount to rape, but exceeded the limits of medical treatment.

"At the beginning of the treatment, he placed a vibrating device on the complainants' genitals, and asked them to rate their sensation according to a scale that includes different degrees of arousal and sexual pleasure," the sentence read.

"These actions do not fall within the scope of legitimate treatment."



Schechter even "did not disagree with that," it was written.

"The complainants' consent was not requested before they were edited and in any case it was not given. This is therefore a conduct that goes against the foundations of the doctor-patient relationship."

According to the judges, she "fundamentally violated the dignity of the patients. She violated their autonomy, she violated the trust they placed in the defendant as a doctor, she looted them, hence the criminal responsibility for indecent acts of fraud."
