A Canadian police officer sued after the death of a black man he severely hit on the head during a heavy-handed arrest in Ottawa was found not guilty on Tuesday.

Constable Daniel Montsion was charged in particular with manslaughter and assault on Abdirahman Abdi, a 37-year-old refugee from Somalia who arrived in Canada in 2009 and suffered from mental illness.

His death had provoked several manifestations of anger in Canada.

Judge Robert Kelly ruled that the prosecution had failed to demonstrate beyond a reasonable doubt that Constable Montsion's beatings during the stop caused the death of the victim, who died shortly after at the hospital.

The facts arose on July 24, 2016 after complaints from female victims of assault in an Ottawa café.

Abdirahman Abdi had fled when the police arrived and Daniel Montson had been called in to reinforce a colleague to chase him down.

The man was caught at the foot of his apartment building, where he was beaten with a baton and sprayed with pepper spray.

When Constable Montsion joined his colleague, a fight broke out with the refugee whom he repeatedly hit on the head with reinforced assault gloves.

The prosecution had denounced excessive violence against Abdirahaman Abdi, who had had a broken nose and brain damage during his arrest.

The man, who suffered from heart problems, died in hospital of a heart attack.

The defense questioned the thesis that the beating during the arrest was the cause of this heart attack.

"The family is devastated by this decision,"

lawyer Lawrence Greenspon, who is also leading civil proceedings for the victim's family, told reporters.

“Abdirahman Abdi came from a country in civil war,

” he continued.

“He came (to Canada) to seek freedom and security.

Before July 26, 2016, he had never had the slightest scratch. "
