Poland: Supreme Court declares abortion law unconstitutional

The strict abortion law in Poland allows abortions, among other things, if the unborn child has severe malformations. The Constitutional Court has now overturned this exception.

Poland is heading for a further tightening of its already strict abortion law.

The Constitutional Court in Warsaw declared a previously applicable exemption from the abortion ban to be unconstitutional.

According to this, termination of pregnancy was previously permitted if the unborn child had severe malformations.

According to the judges, this violates the right to life guaranteed in the Polish constitution.

More than 100 MPs, mostly from the ranks of the ruling law and justice party (PiS), had turned to the highest Polish court with their criticism of the current legal situation.

In 2019, only around 1,100 abortions were carried out in the hospitals of the strongly Catholic country - in almost all cases due to the paragraph that has now been declared unlawful.
