Pan Letao, the husband of the Secretary of Justice Zheng Ruohua, was accused of setting up a pool in the garden without an application for a house under his name.
He was voted for violating the Buildings Ordinance and was convicted last year and fined 20,000 yuan.
He appealed against him.
The case was heard in the High Court today (22nd). Pan’s lawyer claimed that the pool involved was similar to a children’s paddling pool and that the illegal “construction work” referred to in the law was considered improper. The prosecution retorted that the pool was as big as a room Big, and Pan’s experts have never inspected the pool on-site.
After the judge heard his resignation, the sentence was postponed.
The defendant, Pan Letao, was previously ruled that from April 2, 2017 to January 9, 2018, as the owner of House 3 of Haishi Villa in Siu Lam, Tuen Mun, he knew that he had not obtained prior written approval and written consent from the Building Authority , Then start or carry out construction works at the above site, that is, a pool structure; in violation of Sections 14(1) and 40(1AA) of Chapter 123 of the Buildings Ordinance.
The pool involved was demolished the year before.
Pan Letao also attended court today, but declined to comment on the case.

The pool is not made of cement
The main dispute in this case is whether the construction of the pool involved is a "construction work" as referred to by the law, and the approval of the Buildings Department can be obtained first.
The lawyer representing Pan pointed out that the pool involved was not made of cement, but was similar to a children's swimming pool. Therefore, it was not a "building" as referred to in the law involved.
Pan also pointed out that the prosecution failed to prove that the project involved in the case was a "construction work" from factors such as the permanence of the pool and the ease of assembly and disassembly.

The representative of the Department of Justice responded that the pool involved can hold about 14 metric tons of water and is about the same size as a bedroom, which may affect the safety of the structure.
It was also alleged that Pan’s expert witness believed that the pool involved in the case would not endanger the safety of the building, but the expert did not inspect the pool on-site, and only went to the warehouse to check the components of the pool after the pool was removed.
