Judge Fernando Caunedo, of the National Criminal and Correctional Court No. 39, has until Friday to define the situation of

Alberto José Márcico (60)

and, in principle, one of his sons,

Lucas (32)

, both accused in a caused by scams related to the real estate sector.

It has three variants: provisionally dictate a lack of merit (implies that it will continue investigating it), dismiss it or prosecute it.

While this definition is awaited, a new complainant requested, through her lawyer, to be included in the case and presented a document before the judge detailing a real estate transaction with the firm "Edificio Migueletes 1268 SRL" in July 2018, for an apartment and a garage in the 1753/55 Quintela Martín Street building, purchased for

a total of 205,000 dollars

(US $ 180.00 and US $ 25,000).

The woman took possession of those properties, unlike the other complainants, but still could not deed.

"Surely he saw everything that was made public, took note of the situation and asked to be included in the case because the SRL was presented in competition and has everything seized, and

in that context he may never be able to get a deed,"

he confirmed to Clarín a source with access to the cause.

Alberto Márcico is accused along with his father and his two children.

From friends to enemies

"Martín, yes, solve it, Martín. If I had wanted to shit you, I would have already shitted you, I would not have paid you a mango cut in half ... (...) I never crossed a shit, nor did I shit anyone ( ...)

Are you sending me a criminal case today? It's crazy what you did, it's crazy

(...) Be careful with the advice you have, the lawyers are all sons of bitches, all of them. I now introduce myself in summons or in bankruptcy, and no matter what you do, forget it, you don't charge more, nobody charges (...) It catches my attention (...) But it depends on you too.

Do you want to continue with the trial ? Judge me, then we see where we end up.

It attracts my attention. Bye Martín, bye ... "

Martín Horacio Herrera (50)

, former goalkeeper for Boca, Ferro, Estudiantes de La Plata, Alavés de España, among other teams, was the first to denounce "Beto" Márcico (60).

He complains about the five apartments that he bought and never gave her.

The operation was carried out between November and December 2012, when the former goalkeeper bought two apartments in Roosevelt 3607 for 80 thousand dollars each and three units of a building in Migueletes at 1200 for 255 thousand dollars, 155 thousand dollars and 165 thousand dollars. cash.

In exchange, "Beto" gave him sales tickets.

Márcico and his son Lucas testified and both agreed that they were "loans" and that the tickets were signed as a "guarantee."

They had already done another business before, a precedent that according to Herrera himself had not hurt his trust towards Márcico and his family environment, since the companies created also included the father of 10 and his two children.

In 2008, Márcico created the SA "Los Loft de Godoy Cruz" and offered Herrera the possibility of investing a tower that he was going to build in Palermo.

The goalkeeper put $ 300,000 in exchange for some departments, according to the file that

Clarín

had access to

.

That same year, they "sealed" another agreement, for the same amount, but for the entire ground floor of the Migueletes 1268 building. For some reason, three years later the operation was canceled and "Beto" returned the money to his ex partner.

The following year, in 2012, a new business brought them together, the already detailed one of the five departments, but everything indicates that the end will not be on good terms.

In fact, it no longer is: a court case is ongoing.

Even Herrera, who lives in Córdoba (now the sub-secretary of Sports for Río Cuarto) traveled to Buenos Aires at the time to see the Migueletes apartments.

But there were people living.

That's when the archer started a lawsuit against his friend last year.

"There was a double sale of the apartments and, in some cases, up to a third,"

a source in the case

told

Clarín

.

And that's not all.

The case advances and was joined by the complaint of a woman, Marta Zulema Rondinella (72), owner of a financial company with ties to the passes of soccer players, who said that at the end of 2016 she decided to

invest 750 thousand dollars in a tower

that society “Edificio Migueletes 1268 SRL”, also made up of Lucas (32) and Pablo (35) Márcico, sons of the former Boca hitch.

But it would not be left alone in that, which is enough and raises the amount of the scam a few bills below a

million and a half dollars.

"There are more victims, at least two more, and they are from the soccer environment,"

lawyer José Pelleriti, who represents Herrera in this case

, confirmed to

Clarín

.

Also affected by frustrated real estate investments are physical trainer

Javier Valdecantos and former player Favio "Yagui" Fernández,

who are analyzing incorporating their cases into the file.

"Martín, next week we get together. If we don't find a solution, I will continue with the trial, then we will see where we ended up. Everyone I went to see was told 'I continued with the trial this one' ... (...) You may not meet with me, you meet with a lawyer, without threat of anything, eh, nothing, but there you solve it with them (...)

But be careful with your lawyers, eh, they will send you to death with this

With the other, be careful, it is not so, take a good look, I know them. Bye Martín, bye crazy ",

is heard in another of the voice messages.

Martín Herrera, in his days as an archer for Estudiantes de la Plata.

He shared a campus with Márcico in the '90s.

The audios were also added to the cause and for Pelleriti they are enough evidence to go for more: threat and extortion.

This will be resolved by Justice.

"Beto" and Lucas Márcico were summoned to testify for last Wednesday and Thursday, respectively, before court No. 39. As this newspaper learned, through their defense, the Márcicos asked to postpone the investigation and were summoned again for the October 14 and 15.

Meanwhile,

Lucas Márcico decided to appoint a different lawyer than his father.

Why only the two of them when, in reality, the societies included Márcico's father and another of his sons?

Because in principle they are the main involved.

In fact, it is believed that their usual maneuver was to periodically modify the composition of the board of directors of the companies so as not to charge everything on a single firm.

"Márcico must be punished for the scam and my client must obtain the deeds of the departments. There is a notary public also involved, she is responsible as well," said Pelleriti.

That person is Noemí Beatriz Zambrano, with her studio on Av. De Mayo al 1300.

The case of the businesswoman

Rondinella had agreed with Márcico to purchase some apartments in a building on Benito Quinquela Martín Street in 1700, in Barracas.

According to the account of the businesswoman, they agreed to deliver the

16 apartments and 6 garages

for May 1, 2018. That did not happen and the formal route began.

First, document letters and then a deed trial before Civil Court No. 29, which ordered the seizure of the building.

A year later, "Beto" acknowledged the sale of the apartments and garages to Rondinella, the receipt of the money and the delivery of the tickets.

In that agreement, Márcico handed over possession of the properties to the woman.

The surprise came when the buyer went to the place to certify that everything was in good condition and they found that

several of the departments were occupied.

But there was going to be more: upon learning what had happened, Lucas Alberto Márcico, manager of “Edificio Migueletes 1268 SRL”, declared in the file that his father had exceeded his functions and that 10 departments had already been handed over to people which he called "ticket holders."

Lucas also said that the tickets that Rondinella had were a kind of guarantee of the 750 thousand dollars that he had given them.

After that episode, the Márcicos offered the woman a similar operation under the condition that they did not request information from the Real Estate Registry.

Márcico and Herrera, on a trip to Córdoba, in Boca de los '90.

What the researchers suspect is that by making sales by ticket, by not being registered, Márcico could sell the same apartment to several people.

The case against "Beto" and his son Lucas is being processed in the National Criminal and Correctional Court No. 39. Prosecutor Andrés Madrea requested the unification of the two complaints and ordered the Fraud and Fraud Division of the City Police to make a survey in each of the disputed departments to know if they are inhabited and under what title.

In several cases, the investigators found that

the people who live there had also given the money to Márcico

and in return received a sales ticket.

The reality is that the Roosevelt tower also seems to be "loose of papers" since, according to the file, none of the departments could be notarized due to a "problem with the construction company."

“What he says is that this was by way of a loan, that the tickets were given as collateral or collateral.

But that is not an adequate instrument to respond to a loan.

Herrera is not a lender either, and if they had agreed to something like this, Márcico for two or three years did not give his friend any answers, "said a source with access to the file.

Consulted by this newspaper, the former 10 of Boca said that his version of events will be provided to the Justice: "I prefer to do it in the right place."
