DNA on airbag convicts perpetrators

In the end, four criminal offenses, eight witnesses and two experts were the components of a trial against a 41-year-old from Leipzig who until recently lived in Bad Wiessee.

Bad Wiessee -

It was a real chain reaction that the 41-year-old triggered on New Year's Eve 2018.

According to the prosecutor, it all started when the man with more than two per thousand sat behind the wheel of his vehicle.

At around 6 a.m. on New Year's morning, according to the penal order, the defendant drove into a tree in Lochham and caused damage of almost 650 euros to it.

Then he should have left the scene of the accident on foot.

He simply left his car that had crashed and went to Holzkirchen.

The Leipzig man took a taxi there to take him back to Bad Wiessee.

The 41-year-old is said to have told the taxi driver about his accident and insistently pointed out that this taxi ride never took place.

Drunk driving, unauthorized removal from the scene of the accident and coercion was followed by crime number four: faking a crime.

The ex-Wiesseer is said to have reported his car as stolen to the police in order to cover up the truth.

A whole bunch of allegations that rained down on the 41-year-old, but to which he had nothing to say at the hearing at the Miesbach district court.

He stayed silent.

The taxi driver who testified as a witness was more talkative.

"Yes, he told me about his accident," said the Holzkirchner (43).

"If you tell someone that, then I'll find you," the witness quoted the threat from his passenger at the time, who gave him a tip of 30 euros.

The 43-year-old was scared.

So much so that he made two false statements himself to the police.

“Only when I made my third statement,” said the Holzkirchner, he came out with the truth.

Judge Walter Leitner's statement alone would have been enough to convict him.

He even gave the accused the chance to withdraw his objection.

But the defendant denied - with which he tripped himself.

An expert (56) from the Bavarian State Criminal Police Office in Munich carried out an examination of the airbags on the accident vehicle.

“Human DNA can be found on the side airbag,” says the expert.

Hit: The DNA on the airbag matched that of the defendant.

"This is really fantastic evidence, the track hit on the airbag is a real treat," said the judge with a smile.

In addition to some neighbors, police officers who were familiar with the procedure also testified.

Regarding the last charge, a 53-year-old officer from the Bad Wiessee police station stated that the defendant had come to the office and reported two men "whom he claims to have met on New Year's Eve in Bad Tölz".

They supposedly drove to him and stole his car after drinking a lot of alcohol.

The 41-year-old should get his receipt for his construct of criminal offenses, pretenses, attempts to thwart and the silence in court, as was already evident from the pleading of the prosecutor.

Defense attorney Claudia Neuberger tried to save what could no longer be saved: "It cannot be proven beyond doubt that my client also drove the car himself." In addition, the taxi driver was not forced to.

For them, an acquittal is the only correct option.

The matter was then clear to Judge Walter Leitner.

He found the ex-Wiesseer guilty on all four counts and sentenced him to 130 daily rates of 60 euros each - on top of that there are seven months of driving license withdrawal.
