(CNN Spanish) -
A judge in Bolivia annulled an arrest warrant and indictment against former President Evo Morales for an alleged crime of terrorism in the so-called “Audio Case”.
Román Castro, the first criminal investigating magistrate of La Paz, granted this protection because in the background analysis he saw the violation of fundamental rights, especially the right to defense, according to Jorge Quino, president of the Court of Justice of that Department.
In a statement to the media, the departmental prosecutor of La Paz, Marco Antonio Cossío, explained that the notification through edicts was rendered ineffective because it should have been done through international cooperation.
Quino said that at the time these edicts were issued, it was already known that Morales was living in Argentina.
The ruling that granted the guardianship in favor of the former president now goes to the Plurinational Constitutional Court, in charge of ratifying the decision or not.
CNN contacted the defense of Evo Morales on Tuesday, but has not yet obtained a response.
