The Ministry of Health has announced that it will provide primary medical assistance by telephone to victims of sexual assault following the corona, but in practice this has not been implemented.

According to the ministry, only in a few cases were there attempts to get the phone answer, but the treatment promised six months ago was not given to them either.

In addition, the ministry argued that a sexual assault incident does not necessarily meet the criteria of a "medical emergency" under the law.

"All centers receive telephone counseling calls from professionals in the field regarding coordination of referrals or counseling regarding cases such as: police, social workers, hospitals, assistance centers, etc. on a regular and continuous basis. In some centers, individual inquiries were received that clarified the center's response by telephone, but not Reached for treatment, "the Ministry of Health answered the Walla!

"The right of Israeli residents to receive emergency care is denied."

The director of the Lobby for the War on Sexual Violence, Yael Scherer, said she was not surprised.

"The Ministry of Health has issued directives to hospitals to provide emergency service to victims of sexual violence online as well, but the directive is being ignored by hospitals. The Ministry of Health knows this and admits it fails to enforce the guidelines it has set," she said.

According to Scherer, already at the beginning of the Corona crisis, in March, "they appealed to the Ministry of Health to set a uniform and mandatory standard for online medical care for all who need it in the State of Israel, without discrimination and unconditional, and enforce the guidelines until their full implementation. The right of Israeli residents to receive emergency care online as they deserve, in blatant violation of the Patient Rights Law. "

In April, the ministry issued guidelines on the subject, according to which victims and victims of sexual assault will be able to receive initial medical advice by telephone from the staff in the acute rooms in exceptional cases, and will not be required to physically arrive for treatment.

Apparently, the low number of referrals received since then is due to the fact that many do not know about the possibility of receiving the answer.

Awareness of this is not yet high, and hospitals are only partially promoting it.

Published this week in Walla!

NEWS that the conversation with a doctor is conditional on a previous conversation with a social worker.

"In the evening and at night, the initial call usually reaches the emergency room for the brother who will forward the referral to the center's founding social worker. A call with a doctor will not be allowed," read a presentation by the Ministry of Health.

The Association for Civil Rights and the Lobby for the War on Sexual Violence have appealed to the Ministry of Health to repeal the stipulation and said that this contradicts the Patient Rights Act.

"Forcing such a conversation on women (and men) who have just been sexually assaulted, and blocking their path to medical treatment until it is carried out, may intensify their trauma," they wrote.

Scherer further explained that this is an impossible procedure for a victim who has to switch between several different branches and tell about the past attack.

Ministry of Health: "Sexual assault incident - not necessarily an emergency"

The Ministry of Health said that even in the acute center, the procedure is that in the first stage the victim meets with a social worker who accompanies the procedure, whose job is to "perform an initial needs assessment and transfer treatment to appropriate professionals - including a doctor, as needed. This is the procedure. "The exceptions in which it was decided to allow, exceptionally for the current period, to give a telephone answer. Only following the allegations that arose at the beginning of the plague did it become difficult to reach a medical institution during this period," it was reported.

The ministry also said that "a sexual assault incident is a traumatic and severe event, with mental and physical consequences, but does not necessarily fall within the definition of 'medical emergency' in the Patient's Rights Law. In particular, it is difficult to claim that it is a medical emergency as defined by law. Clal comes to the medical institution and the connection is by telephone. "

According to the ministry, "In our opinion, the justification for continuing this unusual procedure has diminished and the cases where it is needed are very rare. To illustrate the requirements, it is important to note that there is a medical and even legal difficulty in prescribing medication, It should be borne in mind that some pharmacological treatment of such a condition may have health consequences and the need for further follow-up. That requires a different solution. "
