A former foreman of a construction subcontractor, who requested and collected illegal commissions and salaries of approximately 36,000 yuan from four workers recruited by him, was prosecuted by the Independent Commission Against Corruption earlier. The defendant was sentenced to 9 months' imprisonment at the Eastern Magistracy today (28th).

A former foreman of a construction subcontractor, who requested and collected illegal commissions and salaries of approximately 36,000 yuan from four workers recruited by him, was prosecuted by the Independent Commission Against Corruption earlier.

Defendant Zhang Xiaohui (60 years old), a former foreman of Liangbei Formwork Engineering Co., Ltd. (Liangbei Formwork), was ordered by Chief Magistrate Qian Li to return the illegal commission amount of 17,725 yuan to Liangbei Formwork.

The defendant earlier pleaded guilty to six counts, namely one fraud, which violated section 16A of the Theft Ordinance; one agent soliciting benefits and four agents accepting benefits, all violating section 9(1) of the Prevention of Bribery Ordinance ( a) Article.

Involved in false claims that the company's policy requires part of the salary

The case revealed that the defendant was a foreman for the formwork subcontractor Liangcup formwork at the time of the case.

Liangbei Formwork was contracted to carry out formwork works on a construction site in Western District in May 2017, and the defendant was appointed to recruit workers for the project.

The defendant recruited a worker for the project in December 2017 with a daily salary of 1,250 yuan.

The defendant told the worker that according to the company’s policy, the other party had to return 250 yuan to the beam mold every working day.

The worker believed the defendant and feared losing his job if he did not comply.

From December 2017 to May 2018, the worker deposited a total of more than 14,000 yuan into the defendant’s personal private bank account, which involved 56.5 working days, and transferred another 4,000 yuan to the account.

The case revealed that Liangbei Formwork never required or authorized the defendant to collect salary payments from the worker.

The worker resigned after 16 days of work and paid the defendant about 5,000 yuan to avoid trouble.

The facts of the case also revealed that the defendant asked two other workers to pay him 150 yuan per working day as a rebate.

From February to May 2018, he collected a total of more than 12,700 yuan from the two workers so that they could be employed by Liangbei Formwork.
