The social leader

Juan Grabois

described as a "

defeat

" the ruling of the judge María Carolina Castagno who ordered the eviction of the Etchevehere family's camp taken by its militants in Entre Ríos and confirmed that they will withdraw from the property in the next few hours.

“We have decided as Project Artigas to withdraw from the Casa Nueva establishment and continue the battle in court.

We retired sadly,

but with the dignity of giving a noble, dignified, fair fight, "he said in an extensive letter posted on social networks.

We will not deny it.

We have suffered a defeat.

A defeat that hurts and saddens us.

It hurts us for Dolores, an emblematic victim of domestic and institutional gender violence.

Dolores, heir to an immeasurable fortune, today is practically destitute, she never received the money that appears in the papers forged by the Etchevehere and their troop of lawyers linked to drug trafficking.

It hurts us for the small producers, peasants, farmers and environmentalists who dreamed of an agroecological project and heroically resisted the violence of the corrupt Etchevehere gang for fourteen days.

It hurts us for the Agrotechnical School to which Dolores wants to restore the lands usurped by her family.

It hurts us for the poor people who hoped that once the tortilla would return and that the powerful would see an institutional limit to their privileges that always ended up prevailing over the needs of the great majority.

We started the Artigas Project with the hope of being able to take an Argentina so full of lies, injustice and dispossession of a little truth, justice and historical reparation.

We started the Artigas Project to plant the flag of another possible agrarian model, without pesticides, clearings, burning pastures, with farmers.

We started the Artigas Project on October 15, the day of rural women, peacefully entering the Casa Nueva field with the legitimate heir who had given 40% of her inheritance to the project.

We began the Artigas Project by activating a series of criminal complaints for the multiple crimes of the corrupt Etchevehere, in particular of the former Minister of Agroindustry Luis Etchevehere, for complicity with drug crime, extortion, economic violence, massive tax evasion, illegal land appropriation, administration fraudulent, environmental crimes among others.

We started the artigas project by denouncing a power pact, transversal to all political forces, to the entire judicial corporation, which supports a model of land concentration, dispossession of the weak and environmental destruction.

At all times using the institutional channels and we comply with the law even knowing that justice is not neutral, that the Public Prosecutor's Office is totally bought by the Etchevehere, that the institutions tend to side with the bosses and the powerful.

The power pact is still in force.

It is no coincidence that this very day a repressive and violent eviction was carried out in an untimely manner on the lands of Guernica.

How right Picasso was in his dialogue with the Nazis about the famous painting that depicted the fascist violence against that Spanish city.

The painter was asked: "Was it you who did this?"

and he replied: "No, to tell the truth, this was done by you."

This applies today to our Guernica with shattered squares and hurt humble people, to the pathetic picture of misery in Argentina that seems to not hit bottom or to know the alternatives offered by our government to solve it, to the successive victories of the economic powers against any attempt by those below to restore a certain balance in a criminally unequal and exclusive society.

As you all know, last week Judge Flores ruled in favor of our cause.

In that same ruling, the rights of Dolores were established to occupy together with the members of the Artigas Project a portion of the land that she inherited and rejected the claims of the corrupt Etchevehere.

Later, a perimeter was established in court as a result of the multiple threats that Dolores, her children and her colleagues from the Artigas Project received.

The corrupt Etchevehere did not respect her, they openly defied her, with impunity.

The power of the rich rurality established a packet picket in front of the gate, preventing circulation, a picket that had the face-to-face support of reputed leaders of Alianza Cambiemos and the institutional support of the Auditor General of the Nation.

Thus, the Etchevehere clan gave a master class in power, imposing itself on a cowardly state that is never encouraged by the elites, but does not hesitate to suppress the poor.

At that time, the machinery of softening judges, politicians, even priests and social movements began to operate at full speed, with Grupo Clarín at the head, the army of macrista trolls as second fiddle and the inestimable collaboration of those who want neoliberal policies and repressive under the poncho of the popular government.

Their arguments, always the same: exclusive legal security for the rich, exclusive private property for the rich.

They were resoundingly successful: they managed to force various public figures to “detach” from the alleged usurpation that never existed, gaining tacit support for Etchevehere's claims.

In this context, the judge ruled in his favor, ordering the immediate restitution of the field.

Our legal team has appealed this decision and we are awaiting the resolution on admissibility to higher law.

However, we have decided as Proyecto Artigas to withdraw from the Casa Nueva establishment and continue the battle in court.

This technical defense, partially in my charge, has advised Dolores the same attitude.

However, she is unwilling to let herself be humiliated again.

We understand it.

We are not going to abandon it.

Together with her, a group of women will remain to protect their human rights against any police or para-police action that is carried out and thus guarantee that the constitutional guarantees of Dolores are respected.

We reiterate, the decision is not final, there are still instances of appeal.

We have lost a battle, a battle in the long struggle for social justice.

Our lives are consecrated to the cause of the poor and working people, to the sacred rights to land, shelter and work.

We fight with the constitution in hand and the strength of the popular movements.

They with the arrogance of power and their immense capacity for corruption and co-optation of democratic institutions.

It is an unequal fight but we are convinced that sooner or later we will triumph.

Argentina carries the weight of 120 years of oligarchic hegemony, with some brief moments of progress in terms of social justice.

We will not get out of this well without structural reforms.

For this reason, we continue to raise the flags of Artigas: Great Homeland and Agrarian Reform.

We call on the poor and their organizations, the youth who struggle, the environmental militancy and the consequent militancy of the popular camp never to lower the banners of political sovereignty, economic independence and social justice;

to fight with the hands, the head and the heart for land, roof and work.

To President Fernández, to Governor Bordet, to Governor Kicillof, to the institutional powers of democracy, we ask you to stop giving in to the factual power.

That same power is what destabilizes Argentina politically and economically.

The recurring concessions are not going to calm them down.

They are voraciously ambitious, they want everything to themselves.

You have to put a brake on them.

To give just one example, today the corrupt Etchevehere continue to usurp the lands of the Agrotechnical School: is there not an “immediate restitution” for these children?

I also ask you to reflect on the words of Pope Francis in his last encyclical: “the right to private property can only be considered as a secondary natural right and derived from the principle of the universal destiny of created goods, and this has very concrete consequences that must be reflected in the functioning of society.

But it often happens that secondary rights override priority and original rights, leaving them without practical relevance ".

I reiterate.

We are going to abide by the judge's ruling today.

We leave Casa Nueva at 7pm.

We retire sad, but with the dignity of giving a noble, dignified, fair fight.

We ask the provincial government to guarantee the safety of the people who will withdraw and allow them to make press statements freely.

As a great Latin American revolutionary used to say, "we don't live by celebrating victories but overcoming defeats": we are going to overcome this defeat.

The fighting continues.

The Artigas Project, the Agrarian Reform, the Urban Integration, the Popular Economy are possible and necessary utopias of integral human development that vibrate in our hearts.

The fighting continues!

The court ruling

In the operative part of the ruling, Judge Castagno ordered

the appeals

that had been filed by the prosecution and the complaint, which had questioned the resolution of the La Paz judge,

Raúl Flores

, who days ago rejected the eviction.

Among other issues, the head of the Court of Trial and Appeals of Paraná considered that the field in conflict belongs to the company Las Margaritas SA and

not to Dolores Etchevehere

;

that the property is not part of the estate and that the woman renounced her shares in the company.

Likewise, the judge ordered the Police of the province of Entre Ríos to

initiate the launch

(eviction) and "make the crime stop immediately, with the greatest care for people and property, identifying the occupants."

After knowing the ruling, one of Dolores's lawyers, Facundo Taboada, announced that the judicial decision will be

appealed

: "

We are going to appeal

this decision of the judge and that is with suspensive effect until the higher court decides. We are not going to leave. from the field, "he said.

Luis Etchevehere celebrates the court ruling with his mother and the head of the PRO, Patricia Bullrich, who arrived at the Entre Ríos field this Thursday.

When asked if Dolores and the activists of social organizations that accompany her are going to withdraw from the Casa Blanca room, he replied: "Now what happens is what is known as suspensive effects, which is when each of the judges decides , but the situation in fact remains the same, until the last judge decides. "

Meanwhile, Luis Etchevehere, former Minister of Agriculture of the Macri Government and one of the owners of the field, assured that

"it is important not to lose calm"

, and asked that this case "serve so that people can trust justice and the right".

"We are going to wait outside until the last usurper comes out and just then we are going to enter our house," he told the media stationed in front of the gate the family field, accompanied by the head of the PRO, Patricia Bullrich who came to the place.
