After the rally and parade on Hong Kong Island on August 31 last year, clashes broke out in multiple districts. By the evening, a large number of demonstrators gathered in Wan Chai. Eight persons arrested in Wan Chai that night were charged with riots and other crimes. They denied the charges and the cases are heard in the District Court.

With the exception of Chen Hongxiu, a female social worker who was on the scene to persuade the police to calm down, she was ruled to be unfounded and released.

The remaining 7 defendants must continue to face charges. They heard a ruling in the District Court today (31st). Judge Shen Xiaomin ruled that all 7 defendants were not guilty.

7 people charged with riots, 1 charged with petrol bombs

The 4 male and 3 female defendants are: Yu Deying (24 years old, self-employed), Lai Siqi (23 years old, female, student), Zhong Jianeng (27 years old, computer programmer), Gong Zishun (23 years old, chef), Jian Jiakang (19 Years old, unemployed), Mo Jiaqing (24 years old, female), Liang Yanbin (25 years old, unemployed).

They were both charged with one count of riot. The charge accused them of participating in the riot along with other people along Hennessy Road and Luard Road in Wan Chai on August 31 last year.

Gong was also charged with one count of possession of an offensive weapon in a public place, alleging that he was in possession of a petrol bomb and a telescopic stick outside 117-123 Hennessy Road, Wan Chai on the same day.

Judge Shen Xiaomin only read the verdict in court, and said that all the accused were not guilty of all charges, and the detailed justifications would be given in writing, and bystanders in the court cheered loudly.

Relatives and friends of the defendant's family members also congratulated each other, and their excitement was hard to conceal.

Chen Hongxiu, a social worker who had been ruled unfounded earlier, was also present.

The defendants did not fully prove to participate in the activities at the scene

Official Shen said in a written ruling that the court must convict the defendant based on the defendant’s clothing, attire, location of arrest, etc. However, the evidence in front of the court can at least point out another possibility: the defendant has just arrived at the scene but has not had time to participate. Any activity was arrested by the police, and there was no evidence to prove what the defendant did at the scene and whether it actually encouraged other people in the crime, and the fact that the defendant was at the scene of the crime is not enough to prove their guilt.

Official Shen also believed that some police officers did not keep records, and some evidences were exaggerated and false. In addition, some defendants were beaten to the head even after being subdued. They questioned whether they had used force and finally ruled that all defendants were not guilty. .

The conflict on Hong Kong Island turned into a riot on August 31 last year.

Occupy Road and Burning Southorn Stand

The police then pushed forward, and several defendants were arrested outside the China Overseas Building on Hennessy Road.

The arrested female social worker Chen Hongxiu was ruled earlier that the evidence was not valid.

The defendant was recognized wearing white socks

The police officer who arrested the first defendant Yu Deying, Chen Zejun, confessed earlier that he saw Yu wearing white socks in the crowd during the dispersal. He pointed at the police officer with an umbrella and hit the ground.

However, the defense questioned that Chen did not mention in his confession that he used an umbrella to point at the police officer and questioned him constantly changing his confession.

Chen denied that and pointed out that Yu pointed at the police officer with an umbrella, expressing intimidation and hating the police.

One defendant contained petrol bombs and telescopic sticks in his backpack

Sergeant Huang Zicheng confessed that when he rushed to arrest the fourth defendant Gong Zishun, the other party resisted, dropped his rucksack on the ground and ran away.

Huang picked up the backpack and found a petrol bomb and police baton.

The defense questioned, Huang put the stick picked up on the ground into his backpack, Huang denied.

The police officer admitted that he did not deal with the evidence immediately when he gave evidence

In addition, police officer Su Dalong confessed that after seizing the rucksack involved, he brought it back to the police station and put it in a drawer.

Five days later, he poured the liquid in the petrol bomb into a plastic bottle, and then sent the glass bottle and liquid to the laboratory.

He only took pictures of the rucksack and baton on September 23.

Su admitted that he was negligent in his duties and failed to process the exhibits and take photos immediately.

In addition, he also admitted that he violated the procedure by not handling the liquid in the presence of other police officers and putting it in the evidence bag.
