The decision of the federal government makes vacation impossible in principle: "

This means: Hotels and holiday homes are no longer allowed to accept holidaymakers.
For the lawyer Jan Bartholl, the situation is clear: “If the basic travel criteria

withdraw from a package tour contract free of charge without any problems
.
In the case of individual travel, the ban on tourist travel means that the business basis has ceased to exist, which means that here too you do not have to pay for services that you do not use, ”he explains to the online portal Travelbook.
Travel lawyer Paul Degott has a similar opinion towards the Reisereporter portal: Vacationers have a right to get their money back for a booked room if the accommodations are not allowed to accommodate them due to a regulation.
The Federation of German Consumer Organizations recommends referring to the "
impossibility of performance
" - both for package tours and for individual trips.
For Bartholl, the type of booking also
determines whether you should cancel the trip on your own
: "Package travelers can cancel immediately, because the legal situation is clear here and the earlier you cancel, the sooner you will get your money back." However, the hotel operator has to cancel the booking, as he cannot fulfill the contract due to the current regulations.
However, if the hotel is a long time coming, the lawyer advises: "Do not cancel on your own, wait until the time of travel and then explain that you could not travel and then ask for the money back."
Domestic tourism: are day trips allowed in Germany during the lockdown?
Day trips are
not explicitly forbidden
in the resolution of October 28th
, but it says: “Citizens are asked to generally refrain from
unnecessary private trips and visits
- including from relatives.

. ”This means that parents or friends can theoretically be visited - as long as the requirement of a maximum of ten people and two households is complied with - but the federal and state governments urge people to refrain from doing so.
