Alert in the ruling party: a new contest for the positions of Bruglia and Bertuzzi could take several years

The Supreme Court ordered it in the ruling, but the procedure has stages and can be challenged. The last contest of a chambermaid lasted ten years.

The ruling of the Supreme Court that ordered to keep the chambermaids Pablo Bertuzzi and Leopoldo Bruglia in their positions provisionally begins to disturb the ruling party.

In the resolution, the magistrates decided that the chambermaids

may remain in their positions temporarily

until a new contest

in which they will be able to participate is held.

The procedure will remain in the hands of the

Council of the Magistracy,

the body in charge of selecting the judges.

But

the times of that contest

begin to set off the alarms of the ruling party: it could take years to become effective.

In fact, it would mean that the two judges appointed by the K could stay much longer than expected by the Government. 

Judicial experts recall the duration of the last contest that involved a chambermaid.

This is Judge Mariano Llorens, who is a member of Chamber I of the Federal Chamber, the same one in which the Court now ordered a new competition to fill the two vacancies of Bruglia and Bertuzzi.

Llorens' contest lasted 10 years,

started in August 2008 and ended in June 2018 when he was appointed by then-president Mauricio Macri.

The contests are complex systems and have several determined steps, they

explain in Justice.

The first step is the formal call for a contest for the participants to apply, who will then have to take a written test.

In addition, they must overcome a background screening, a challenge stage, and a psychological and psycho-technical examination.

With these results,

an order of merit is put together that must be voted in the Plenary of the Council of the Magistracy with two-thirds of the votes.

With the shortlist in hand, the Council sends it to the Executive Power to send it to Congress.

In fact, each of these stages may suffer delays, obstacles, challenges and drawbacks.

For the opposition councilor, the deputy of Together for Change Pablo Tonelli,

in the ideal situation a contest cannot take less than a year

But in practice this is never the case.

That scenario, with serious delays to advance in the contest for the positions that replace Bruglia and Bertuzzi, is the one that begins to turn on the head of the ruling party.

The most optimistic estimate that it could take between two and three years.

The pandemic also plays a role and could complicate things.

Since the quarantine was ordered last March, no new contests were started and only those that were already advanced were worked.

Today, in fact, the Council has almost finished contest 412 with which it seeks to fill two vacancies for Room II of the Federal Chamber.

Diego Amarante, Roberto Boico, Alejo Ramos Padilla and Pablo Yadarola appear in the list, some with strong ties to Kirchnerism.

A plenary meeting of the Council of the Magistracy that will be key in the contest to replace Bruglia and Bertuzzi.

Boico is Cristina Kirchner's lawyer in the case of the memorandum with Iran.

Ramos Padilla is the person in charge of the D'Alessio case and prosecuted the Clarín journalist, Daniel Santoro.

Third in the list, Ramos Padilla is one of the preferred by the K to occupy a place in the Federal Chamber, although he is also competing for the vacancy that is available in the Federal Court No. 1 of La Plata, a key space because he has the electoral competition of the province of Buenos Aires.

This Thursday,

the members of the Council of the Magistracy will have their first meeting

after the ruling of the Supreme Court that ordered them to hold a new contest to fill the vacancies of Bruglia and Bertuzzi.

It will be in a work meeting, in which only the directors participate and is not public, as plenary sessions or committee meetings tend to be.

They will begin to debate the times and the procedure.

Nobody rules out that there are no tensions.
