President Bashar Al-Assad issued today Legislative Decree No. 31 of 2020 amending some articles of Legislative Decree No. 30 of 3-5-2007, and its amendments, which include the Military Service Law.

The following is the text of the decree:

Legislative Decree No. 31

President of the Republic

Based on the provisions of the constitution

Draws the following:

 Article 1 - Articles (13 - 26 - 95 - 97 - 99 - 100 - 105 - 107 - 113 - 114) of Legislative Decree No. 30 of 5-3-2007 and its amendments containing the Military Service Law shall be amended to become as follows:

1- Article 13:

First:

A- The person charged with compulsory service who has decided to place him in fixed service has the right to pay a cash allowance of three thousand US dollars or its equivalent in Syrian pounds according to the exchange rate determined by the Central Bank of Syria on the date of payment.

B - Military personnel who are in compulsory service shall benefit from the provisions of the previous clause.

Second: The taxpayer residing outside the territories of the Syrian Arab Republic in Arab or foreign countries has the right to pay a cash allowance according to the following:

A- Seven thousand US dollars for those whose residency was not less than four years before or after entering the age of commission.

B- Eight thousand US dollars for those who have been resident for a period of no less than three years and have not completed four years before or after entering the age of commission.

C- Nine thousand US dollars for those who have been resident for a period of no less than two years and have not completed three years before or after entering the age of commission.

D - Ten thousand US dollars for those who have been resident for a period of not less than one year and have not completed two years before or after entering the age of commission.

E- Three thousand US dollars for anyone born in an Arab or foreign country and residing in it

Or with other permanent and continuous residence until he enters the age of commission.

F- Six thousand five hundred US dollars for anyone born and residing in an Arab or foreign country for a period

Not less than ten years before entering the age of commission, and an amount of five hundred dollars shall be deducted from them for each year of residency in excess of that and up to seventeen years inclusive.

Third: A- The provisions of Paragraph (Second) of this Article shall not be applied to the delegated in favor of one of the public authorities.

B - The delegate who has obtained a postgraduate degree for which he was dispatched and for which no less than a master’s degree, and resided in the country of delegation for the period specified in the laws and regulations in force for dispatch, is entitled to pay a cash allowance of six thousand US dollars.

Fourth: A - A taxpayer who wishes to pay the cash allowance and whose residency exceeds five years after entering the age of commission shall be fined to pay an amount of two hundred US dollars for each year of delay.

B - The delegate who wishes to pay the cash allowance will be fined two hundred US dollars for every year of delay following the year in which he obtained the certificate.

C- The part of the year is considered a full year.

Fifthly: A - The taxpayer residing outside the territories of the Syrian Arab Republic may withdraw from the country of residence for a period not exceeding / 90 / days in one calendar year.

B- The taxpayer residing outside the territories of the Syrian Arab Republic may stay inside the country for an additional period of / 60 / days in excess of the period of interruption specified in Clause / A / of this paragraph in exchange for paying an amount of two hundred US dollars, and this period is not counted from the period required to pay the cash allowance.

Sixth: A - A pilot working for the Syrian Airlines Corporation who has been postponed according to Paragraph (Second) of Article / 10 / of this law for a period of five continuous years, or who has completed five years of actual service with the aforementioned institution and continues to practice the profession during which he has the right to pay a cash allowance of the amount Ten thousand US dollars or its equivalent in Syrian pound, according to the exchange rate determined by the Central Bank of Syria on the date of payment.

 B - All civilian pilots are entitled to pay a cash allowance of fifteen thousand US dollars.

2- Add to the end of Article 26 the following paragraph:

E - A permanent resident outside the territories of the Syrian Arab Republic for a period of not less than one year after paying a cash allowance of five thousand US dollars.

3- Article 95- A cash amount of fifteen thousand Syrian pounds shall be imposed on the taxpayer who delays conducting market preparation checks without a legitimate excuse if he is residing within the territories of the Syrian Arab Republic and one hundred US dollars for those who reside outside it.

4- The phrase “or its equivalent in Syrian pound according to the exchange rate determined by the Central Bank of Syria” replaces the phrase “or its equivalent in Syrian pound according to the exchange rate issued by the Central Bank of Syria” wherever it is mentioned in Article 97 /.

5- Article 99- A fine of a cash amount of twenty-five thousand Syrian pounds shall be imposed on every person charged with compulsory service instead of his place of residence registered in the Division of his recruitment after conducting his checks and he did not inform her of that within two months from the date of his occurrence.

6- Article 100- A cash amount of fifteen thousand Syrian pounds shall be imposed on the person charged with compulsory service residing inside the territory of the Syrian Arab Republic, and one hundred US dollars for the taxpayer residing outside it in one of the following two cases:

A- Failure to renew his excuse without a legitimate excuse to ensure that the reasons for the postponement continue.

B - Failure to check market settings.

7 - Article 105 - a - a fine equivalent to the lump sum salary for a first-class soldier for a month, every reservist who failed without a legitimate excuse to fulfill the call addressed to him to ensure the continuation of the reasons for exclusion or to conduct the prescribed checks.

B- This fine does not prevent the continuation of the exclusion if the reasons for it are still present.

8- Article 107- A fine of a cash amount equivalent to the lump sum salary for a first-class soldier for a month, anyone who is released from military service and does not refer to his recruitment division within a month from the date of his discharge without a legitimate excuse.

9 - Article 113 - A fine of a cash amount of twenty five thousand Syrian pounds shall be imposed on every person charged with a course for military service who lost his ID card and did not inform the competent authorities of its loss.

10- Article 114 - A- A fine of twenty thousand Syrian pounds in cash shall be imposed on anyone who lost the military service notebook.

B - A fine in cash amounting to ten thousand Syrian pounds shall be imposed on whoever causes the destruction of the military service notebook.

C - The amount of the fine is collected by the Division of his recruitment for the benefit of the Public Treasury, and in the event of non-payment, it takes place in accordance with the Public Funds Collection Law and is granted a new book.

D- Any person who intentionally destroys his or her military service notebook, or anything else, in whole or in part, shall be punished with imprisonment from three months to two years and a fine of one hundred thousand Syrian pounds, and an administrative fine of twenty thousand Syrian pounds for the value of the new notebook.

Article 2 - The recruitment work system determines the procedures and conditions for accepting the cash allowance and other amounts stipulated in this legislative decree.

Article 3 - It is permissible for the Central Bank of Syria and the Syrian diplomatic missions to collect the amounts that are paid in dollars in this legislative decree with the equivalent in euros, according to what is determined by the Central Bank of Syria.

Article 4- A- Whoever pays the monetary allowance after the enforcement of this legislative decree in accordance with the provisions of paragraphs (second and third) of Article 13 of the Military Service Law amended pursuant to the provisions of this Legislative Decree shall not benefit from the following:

1- Subscription or allocation of housing with any of the public authorities.

2- Granting loans from public banks in the Syrian Arab Republic for a period of five years starting from the date of payment of the consideration.

B- A preferential advantage is given to those who have performed military service (compulsory or reserve) in competitions and tests announced by public authorities according to the principles issued by a decision of the Council of Ministers.

Article 5- This legislative decree shall be published in the official gazette.
