The Sexual Offences Review Subcommittee under the Law Reform Commission today (12th) published a consultation document on "Sentences and Related Matters in the Review of Sexual Offences", which launched a three-month public consultation, covering the review of criminal penalties and studying how Reform and improve the treatment and rehabilitation of sex offenders in Hong Kong.

The document puts forward a number of recommendations regarding the previously published "Review of Substantive Sexual Offences", including the use of sexual assault to replace the existing indecent assault, but the maximum penalty is also 10 years in prison.
In addition, the penalties for the two existing crimes of rape and incest are recommended to continue to be applied to the two proposed crimes of "sexual assault by penetration without consent" and incest. Among them, the maximum punishable penalty for "sexual assault involving penetration" Life imprisonment; "non-intrusive sexual activity" can be imprisoned for 10 years.
In addition, it will propose a new crime of body exposure, with a maximum penalty of 5 years imprisonment, which is a higher sentence than the current 6 months imprisonment for the crime of indecent behavior in public places (exposure of body parts).
At the same time, it will propose new provisions for the crimes of "photographing the bottom of a skirt without consent" and the crime of "voyeurism". The maximum penalty is both imprisonment for 2 years.
Both are the same as the current maximum penalty for loitering.
The committee also recommends that the current checking mechanism for conviction records of sexual offences should cover all existing employees, self-employed persons and volunteer workers; and that the government should assess whether the checking mechanism needs to be changed to mandatory when appropriate.
