The justice ordered Monday, November 16 to the prison administration to improve the conditions of detention in the remand center of Nanterre (Hauts-de-Seine), after being seized by a prisoner.

The summary judge, who rules on an emergency, ruled in his favor, ordering the administration to "

make available

" to the detainee "

an auxiliary heater in accordance with the regulations, to ensure a rapid disinsection procedure, efficient and regular use of all cells, and to wash bed linen and detainees

'

sheets regularly

, ”said the Cergy-Pontoise (Val-d'Oise) administrative court in a press release.

The magistrate also noted that the detainee had been subjected to

unjustified "

punitive and intimidating practices

", in particular "

a complete search without the conditions justifying its use having been met

".

The order of the summary judge, who recalls that the occupancy rate of the Nanterre prison is 130%, notes that the prisoner's cell is "

infested with cockroaches, even on the walls and in the refrigerator

", which constitutes a possible violation of the European Convention on Human Rights.

Last month, the Constitutional Council censored an article of the code of criminal procedure which hampered the appeals of people placed in pre-trial detention, therefore still presumed innocent, in degrading conditions.

He also demanded that a new law in this direction be passed by March 1, 2021. In January, the European Court of Human Rights (ECHR) condemned France for lack of an effective remedy for detainees and inhuman or degrading treatment and recommended that the State “

consider adopting general measures aimed at eliminating overcrowding and improving the material conditions of detention

”.
