Above all, the ÖDP urges the city council to deal with the possible dangers of 5G, the fifth generation of mobile communications technology.

Also, several citizens had already “informed themselves about the transmission systems currently located in Weilheim and a possible 5G expansion,” reports building administration manager Manfred Stork.

In addition, there were "various statements from surrounding citizens' initiatives against 5G" in the town hall.

The city itself has now also obtained statements: the Munich law firm Seufert commissioned a legal opinion on “legal options for controlling mobile radio systems”.

At the same time, the State Office for the Environment (LfU) was asked for answers to questions formulated by ÖDP City Councilor Andreas Halas.

Both reports are already available within the Council and will be the subject of the public city council meeting on Thursday, November 19 - from 6.30 p.m. in the city hall.

Actually they wanted to greet a representative of the Augsburg-based LfU “live”.

During the preliminary consultation in the building committee, Halas was "astonished, amazed and in places irritated" by the written answers from the LfU.

If, as the authority writes, official measurement methods for 5G antennas are not expected to be available until 2021, the ÖDP representative is surprised, "How can this new technology be introduced as early as 2020?"

Halas also criticizes the LfU statement that upgrading cell phone radiation in the carcinogen classification is “not justified from a scientific point of view”.

The LfU is not responsible for such an assessment - and “the actually responsible authority of the WHO” sees the examination of upgrading mobile phone radiation as urgent.

The LfU was unable to give an answer to Halas' question as to whether a technology assessment is available: According to the advice, you have to contact the relevant office of the German Bundestag - what the city of Weilheim now wants to do, as the building committee said.

According to Stork, the legal opinion of the Munich lawyers Seufert covers "the opinion of the city building authority, which has already been expressed several times, according to which there is little room for maneuver for municipalities to take action against cell phone systems or to switch to another technology (e.g. 5G)".

At most, one possibility is a site concept within the framework of a land-use plan - "but with considerable effort," says Stork.

Weilheim's ÖDP does not want to leave that.

This report was submitted to retired administrative judge Bernd Budzinski, who agreed with the descriptions of the state of the Munich office, but not with their conclusions.

Halas' conclusion in the committee: "We do have opportunities as a municipality and would be badly advised if we do not take advantage of them." There is plenty of material for discussion for the city council meeting on Thursday.

“We are in the process,” said 2nd Mayor Angelika Flock (CSU), who acted as chairperson of the building committee - “and it is far from over”.
