The administrative court of Versailles has decided to cancel the municipal elections in Chesnay-Rocquencourt.
At the end of the ballot, which took place in a single round on March 15, the list led by Richard Delepierre (MoDem), credited with 4,326 votes or 50.44% of the votes cast, was ahead of the list by 76 votes. the outgoing mayor, Philippe Brillault (DVD), who had been at the head of the city since 1989. The latter had obtained 4250 votes, or 49.55%.
Two days before the start of national confinement, participation was particularly low with an abstention of 61.16% of registered voters.
Posters and a Facebook post questioned
In a press release, the administrative court said it had noted "two irregularities" that affected the smooth running of the campaign.
On the one hand, a “wild display” intended for motorists.
Placed on panels, these fluorescent yellow posters described Philippe Brillault as a “liar”.
The judges also mentioned a publication by the Facebook group "Vivre au Chesnay Rocquencourt" questioning "the probity" of the outgoing mayor.
In both cases, which took place 48 hours before the ballot, the court considered that Philippe Brillault had found himself "unable to respond" to these allegations.
The justice therefore estimated "that given the small difference of 76 votes between the two lists, in a context of high abstention, the two irregularities observed altered the sincerity of the ballot.

At the origin of the procedure, Philippe Brillault is obviously satisfied with this judgment.
“I asked the court to rule on the sincerity of this election.
He did and said no.
In addition, I suffered many personal attacks during this campaign.
My honor and that of my family were at stake. It is important that they be washed in this way, ”he assures us.
Richard Delepierre has, for the moment, not responded to our requests.
He now has one month to appeal this decision to the Council of State.
In the meantime, he remains in office at the head of the city of Chesnay-Rocquencourt.

This is the second time in the Yvelines that a poll that took place in March has been canceled.
The first had been that of Chevreuse.
Sébastien Cattaneo (SE), beaten with one voice (1013 against 1014) by the outgoing mayor Anne Héry-Le Pallec (LR) had won his case from the administrative court of Versailles.
But the elected official appealed against this decision to the Council of State on August 6.
Judgment is still awaited.
