Changes to the Infection Protection Act are to be made in an urgent procedure due to Corona.
FDP man Kuhle sharply criticizes the government's actions.
Munich
- The opposition is massively critical of the
infection protection reform
.
Interior expert
Konstantin Kuhle
(FDP) calls for more influence for parliament.
Mr. Kuhle, you have been criticizing the planned amendment to the Infection Protection Act for weeks.
Now you criticize opponents of the plans yourself.
Why?
Kuhle:
You have to separate legitimate questions and criticism from
conspiracy theories
and dictatorship comparisons.
Parallels to the Enabling Act of 1933 are dangerous nonsense.
Of course, the word authorization comes in the
Infection
Protection Act
*
in front.
This is a common process.
The
Federal Government is also authorized to act
in the
Road Traffic
Act.
The topic moves many people.
Alexander Dobrindt recently received 37,000 emails about this.
Kuhle:
He's also head of the
CSU regional group
.
For me it was already 2500 this week. Many of them contained similar formulations and building blocks.
It looks organized.
But some people also have legitimate questions, for example because of the
quotation
requirement
: a law must state which
fundamental rights
are affected by a legal regulation.
Some now believe that the
Infection Protection Act
would
abolish
these
fundamental rights
.
Of course this is not the case.
Your criticism of the content of the draft law remains?
Kuhle:
Yes, gross technical errors were eliminated.
But the criteria according to which the
state governments
may order
certain
measures
are still too general.
Above all, we would have liked to see the
epidemic situation of national importance identified
by the
Bundestag
only persist if it is
confirmed
by
Parliament
every two months
, as in
North Rhine-Westphalia
.
Now we have such a situation, we didn't have it in the summer.
FDP MP Kuhle criticizes the speedy processing of the Infection Protection Act
The government argues that when in doubt, parliament is too slow.
Kuhle:
That is executive arrogance.
The
Parliament
has about fast the
short-time compensation
decided.
Not every individual Corona * measure should be decided, but it should make general considerations for restrictions on
fundamental rights
.
The current change in the Infection Protection Act is going too fast for you.
Kuhle:
The draft was submitted at the beginning of November, and there was a hearing on Thursday with massive
expert criticism
.
Numerous changes were presented on Monday, which the health committee should discuss on the same day and which the
Bundestag
and
Bundesrat
should now
finally vote on.
The
opposition
must have a
little more time
to deal with it.
Will the Corona ordinances become more court-proof with the new law?
Kuhle:
That is difficult to predict, but we will find out very soon.
