Firecrackers and rampant celebrations on New Year's Eve - is that possible in Corona times?
The city council has not decided on any new rules for the time being.
Does the federal government have the last word?
A firecracker ban in Munich * on New Year's Eve is off the table.
The Munich city council voted against the request.
The turn of the year could still be very different due to Corona *.
Munich
- As is well
known, opinions differ
about the sense and nonsense of the
fireworks on New Year's Eve
.
Also in the
city council
.
There, two motions from the parliamentary groups ÖDP / Free Voters (FW) and Left / The Party were discussed in the district administration committee.
The aim of the move was to
ban the burning of fireworks
for New Year's Eve 2020/21 in the entire city area.
What, for example, Richard Progl (Bavarian party) could not understand at all: “One should not take this tradition that has become dear to the people.” Tolerance is appropriate and
not a ban policy
.
And Progl added: "Seldom has it been so necessary to
chase away
a
year with fireworks
."
New Year's Eve in Corona times: light and laser shows as an alternative
Marie Burneleit (The Party) saw it differently.
"We don't have to bawl, we can also smooch and eat raclette this year." Like Tobias Ruff, she demanded a
"ban on bangs"
throughout the city
from the ÖDP
.
For reasons of
environmental protection
, because the
gunfire is
dangerous,
burns
often occur and the hospitals
are already overloaded
in times of the
Corona *
pandemic
, as Burneleit said.
Public
light and laser shows
would be better
- which, by the way, is currently being examined by the economic department.
The
ban application
was ultimately rejected by all other parties.
Legally, this is difficult anyway, although Ruff called on his city council colleagues to “show more courage”.
Responsibility for the
legislation in the Explosives Act
, the
federal government
.
Prohibited zones must be clearly justified and may only affect sensitive areas if there is an acute
risk of fire
for buildings or
danger to life and limb
.
For example in the densely populated
old town
and within the
Middle Ring
, where the bang had degenerated in recent years.
There the
ban
on
fireworks and firecrackers has
proven itself from the point of view of the police and city administration.
The district administration committee therefore decided on Tuesday to apply the rule this year as well.
The
ban on using
outside the
middle ring
, however, is difficult, said district administration officer Thomas Böhle (SPD).
"There would be a risk of a stained carpet." The KVR boss indicated, however: "I can vividly imagine that the legislature will act to protect against
infection
."
New Year's Eve in Corona times: OB Reiter should campaign for more rights on the City Day
Cross-party criticism was that municipalities
hardly have any legal control
when issuing
fireworks
bans.
"We need more freedom here," said Christian Vorländer (SPD).
A request from the CSU was unanimously approved that
Mayor Dieter Reiter
(SPD) should campaign
for changes in this regard
at the
City Council
.
Evelyne Menges (CSU) said that at citizens' meetings it can be seen again and again that a large majority
reject
the
uncontrolled burning of fireworks
.
A thorn in the side of the city council is that for legal reasons there is no
fireworks exclusion zone
around the zoo.
Green spokeswoman Gudrun Lux expressed her
sympathy for the general
application
for a
ban
. It was completely absurd
to allow intoxicated people to
detonate
firecrackers
by virtue of the
Explosives Act
.
Similar to Böhle, however, Lux also prophesied: “There will probably be
restrictions
this year due to the pandemic anyway
.”
