Failure for the AfD in Karlsruhe: Your parliamentary group in the Bundestag is not allowed to sue the other opposition groups against the increase in state party funding by the Union and the SPD.
This has been decided by the Federal Constitutional Court.
30 current and former AfD MPs had applied in Karlsruhe to join a norm review complaint filed by the FDP, the Left and the Greens in 2018.
Such a step is not provided for by law, the court said in support of the grounds.
In addition, the other three opposition factions would not have agreed to join the AfD (Az. 2 BvF 2/18).
At least a quarter of the parliamentarians are required for a norm review suit, so the AfD wanted to join.
When forming the quorum for a norm review complaint, members of the Bundestag should not be forced to "appear together with members of parliament" with whom they did not want to work, the court justified its decision.
In June 2018, the Bundestag decided with the votes of the coalition factions that all parties together should receive 25 million euros more annually.
This corresponded to an increase from 165 to 190 million euros.
This was justified primarily with the new requirements of digitization.
The opposition felt taken by surprise and criticized the approach.
In 2018, the AfD parliamentary group also filed its own complaint against the reform of party funding.
However, the corresponding urgent applications were also unsuccessful in Karlsruhe.
