After the Federal Oral Court 5 (TOF 5) - in charge of the Hotesur and Los Sauces cases - ordered that the tax debts accumulated by the condominium that manages the properties of the Néstor Kichner inheritance be faced by the intervention, the AFIP accepted a moratorium for Máximo Kirchner to pay unpaid taxes for almost four years.

The "Maximum Condominium and Florencia Kirchner" manages 25 properties corresponding to the succession of assets of Néstor Kirchner.
After Cristina Kirchner gave her assets to her children in March 2016, the national deputy became the owner of 50% of the condominium.
In the Los Sauces case - the family real estate agent investigated for having laundered more than $ 80 million - Judge Claudio Bonadio decided in 2016 to intervene not only the company but also the condominium.
Since then, the lawyer Raquel Moyano is in charge of the administration of all this universe of properties.
As the owner of half of each of the assets that make up the condominium, Máximo has tax obligations corresponding to the Personal Assets tax.
In addition, as a result of the rental of the properties, "
during these last years tax obligations have accrued in concept of VAT and Profits
", explained the lawyer Carlos Beraldi, who recalled that the rents of the properties managed by Los Sauces "were and are received by the lawyer Moyano ".
Beraldi explained that the leader of La Cámpora "was dispossessed of his properties, he cannot use them and the funds collected for his location are administered by an auxiliary of justice; (...) he must bear large tax burdens that are a direct and immediate consequence of the registry ownership of real estate from which it was stripped (Personal Assets) and of a commercial activity that, in the current situation, does not provide any revenue (VAT and Profits) ".

How much does Máximo Kirchner owe?
According to his defense attorney, as of August 31, 2020, he owed $ 3,031,079.22 as personal property tax in fiscal periods 2016, 2017, 2018 and 2019, with interest included.
To this must be added the debt for the Human Income Tax, for $ 1,046,520.88.
That is, they
are $ 4,077,599 in total.
For this reason, the deputy decided to take advantage of a tax moratorium, which allows to regularize debts for income tax and personal property.
But he required that the fees not be covered with his salary as a National Deputy, but with the funds received by the condominium.
Thus, on October 26, the process was concluded by which, with an important reduction contemplated by the tax holidays, a total of $ 2 million in total in fixed installments of $ 19,480 per month will be settled.
The same will be faced by the intervention of the condominium that bears the name of the children of Cristina Kirchner.
The lack of cancellation of the claimed debts "can not only entail the auction of the condominium assets, but also generate an unnecessary increase in the liability corresponding to interest, expenses, fines, fees and costs; all of this may frustrate the repair of the social damages caused with the commission of the crimes imputed here to the detriment of the general interests of the society that this Public Ministry must defend ", indicated the Court.
As at present it is the intervention that charges a rent and the one that keeps the profit, the TOF 5 understood that the quotas of the fiscal moratorium to which the national deputy accepted must be paid with those funds and not with the diet from the head of the Frente de Todos block.
They remarked that, although Máximo Kirchner has income from his position in the legislative branch, "it cannot be said that these are enough to cover his maintenance and the payment of the quotas of the general tax moratorium to which he intends to adhere" .

, Kirchner will also have to pay the tax on large fortunes that is discussed in Congress, since he declared that he had 292 million pesos.
In one year, their assets grew by almost 50%.

In March 2016, Cristina gave her children her share of Kirchner's inheritance.
Since then the main fortune of the Kirchner family has been Maximo.
Before the Anticorruption Office (OA) he declared to have 291,739,213.02 pesos, which represents an increase of almost 100 million in one year in relation to the previous fiscal period.
This figure is higher than the assets that Cristina Kirchner had when she left the Casa Rosada, when she declared assets for 77 million pesos.
