The Sexual Offences Review Subcommittee under the Law Reform Commission published a consultation document on "Sentences and Related Matters in the Review of Sexual Offences" in the middle of this month, and launched a three-month public consultation.

The committee recommends a new crime of body exposure with a maximum penalty of 5 years’ imprisonment. It also recommends a new crime of “photographing under the skirt without consent” and “voyeurism” with a maximum penalty of 2 years’ imprisonment.

The Legislative Council Committee on Justice and Legal Affairs discussed the relevant documents today (23). Both the DAB Ge Peifan and the New Democrats Rong Haien believe that the penalties for the crime of "photographing skirts without consent" and the crime of "voyeurism" are low. Zhang Daming, a member of the Crime Review Subcommittee, responded that the penalties were based on British laws, but emphasized that it is still in the consultation stage and there is no final conclusion.

Ge Peifan is concerned about why the maximum penalty for the crime of exposure is higher than the crime of "photographing the bottom of a skirt without consent" and "voyeurism". Zhang Daming explained that the crime of exposure has a specific victim target and is a more serious crime. The penalty is based on the Scottish law. Depends.

Regarding the current sex crimes that do not require mandatory treatment after being in prison, Bao Andy, a member of the Sexual Crime Review Subcommittee, emphasized that they do not recommend compulsory treatment for offenders. They believe that the most effective way is to set up a reward scheme to encourage sex offenders to receive treatment voluntarily to reduce the risk of recurring.

There are suggestions that the review mechanism for sexual conviction records should be extended to expired conviction records. The committee will not make recommendations until the end of the consultation period.
