More than eight months after Alberto Fernández sent Judge Daniel Rafecas' statement to the Senate for Procuration, Cristina Kirchner did not take any steps to treat him or summon the candidate, as the Agreement Commission that is in the hands of the camper must do. Anabel Fernández Sagasti.
Instead, he promoted the modification of the law so that the attorney is appointed not by two-thirds but by an absolute majority, which was rejected by Rafecas, who understands that such a circumstance would diminish his power and independence in front of the prosecutors of the Nation: "If that requirement (to be elected by two thirds) is modified, I will not be willing to assume the position," he said.
The bill, whose opinion was approved last Friday by the Senate Justice Commission and which would be discussed in the Chamber this Friday or next Monday, limits the Attorney General's mandate to 5 years, establishes the majority as a designation mechanism in the Senate absolute and maintains two-thirds for removal.
And it presupposed a new escalation of tensions between the President and his vice, since it would imply
the decline of the Fernández candidate and the enthronement of someone close to Cristina.
However, Fernández, who on Sunday gave three interviews, in which he gave various definitions on various topics, from Spanish politics to adjustment through the fight against the coronavirus, in one of them made a clear nod to the criteria of his vice regarding the appointment of the Attorney.
In his talk with
Radio 10
, Fernández said that it is very feasible that the reform project of the Public Prosecutor's Office will enter the agenda of the special sessions in December.
Asked if he would have to wait until next year for his treatment, the president replied: “No, we discussed it.
I believe that Argentina needs once and for all to have a prosecutor
, who has not had one for many years ”.
"We have to understand that the head of the Public Ministry prosecutors is a very important and very necessary place for the proper functioning of the Justice and hopefully we could resolve it with a consensus," he said.
Fernández agreed with Cristina that
"we have to make the process of appointing officials
in certain institutions
easier
."
Sources from the Casa Rosada explained that, as stated by
Clarín
, the President does not endorse the bill that modifies the Procurator's voting system.
However, they admit that they would seek to reach an agreement with Rafecas to accept being elected by an absolute majority.
That way, he would have the attorney he wants and avoid a further confrontation with his vice.
Fernández admits that the federal judge is "principled", but clarified in the radio interview that "
this is not a problem of principles, it is a practical problem."
For this reason, when asked if he believed that Rafecas could review his position and accept an appointment with a change of rules based on the new project, he replied: “Yes, I think that at first he did not clearly understand what we were talking about.
I think he quickly thought of the commission that exists to appoint judges of the Court that is in the Constitution.
For the President, his candidate "would avoid the media pressure" in which he finds himself.
"Someone who does not deserve it because he is a judge of great technical ability and great moral integrity," he stressed.
Different journalistic versions indicated that this week -possibly this Tuesday- Fernández would see Rafecas again.
It is not clear what the judge will do.
His colleagues assure that he considers consensus essential - two thirds, not an absolute majority - to
hold office with such political pressure
.
Especially since it will also have to designate a new structure with several key prosecutors that are created from the new project.
The president also left the door open for a consensus with the opposition by two thirds, if the project of Christianity does not advance in Deputies.
“I hear some opponents say that Rafecas is wonderful.
So why not say it in the Senate.
I find out from the newspapers, but it must be said in the Senate, "said Fernández, in a message that has Juntos por el Cambio as its main recipient.
Other reports do not rule out that the President sends the Rafecas statement again.
Anyway, in the Chamber of Deputies from the ruling party they assured
Clarín
that today they do not have the votes.
And they do the math but, nevertheless, they reach 126 of the 129 that are needed.
Number that could even be less.
