The defendant Guan Zhigang (58 years old) was charged with 3 counts of indecent assault. He alleged that he indecent assault on woman X in Tuen Mun Children's Home 3 times between January and March 2019. X was 16 at the time of the incident.
Knowing that men and women are not getting married
The magistrate believed that the victim had given his testimony sincerely and was satisfied with his testimony; and refused to accept the defendant's argument of "lack of crisis" and accidental touch.
He pointed out that the defendant was a senior teacher and knew that men and women were incompatible with each other. The victim said that her lower back was painful and the defendant could help in other ways, such as telling her to rest and stretch her muscles, or massage with tools. There is no need for hand massage, and her touch is unnecessary.
The location of the incident was a confined home
The magistrate continued that normal massage would not violate the law, but the incident was not a massage parlor, but a confined institution. The discipline was strict, even if there were restrictions on contact between the same sex, the defendant took the initiative to massage the female students.
He pointed out that although the victim said that she agreed with the massage, it did not mean that the defendant was allowed to reach into her shirt. Moreover, the victim felt strange and scared every time she was touched, reflecting that she did not agree with the defendant's behavior.
The court convicted three crimes of indecent assault and reprimanded the defendant for violating good faith, borrowing words to massage, and breaking the law unscrupulously in the presence of the practitioners.
Not renewed and transferred to half-time tutoring
The defense pleaded to reveal that the married defendant had children and had 18 years of education experience. He joined the crime agency in 2008 and was not renewed after the incident. He is now a part-time tuition teacher and his income has been greatly reduced.
The magistrate finally sentenced the defendant to 6 months in prison, but allowed the defendant to be released on bail pending appeal.
