The Nice administrative court on Monday, November 30 asked the prefect of the Alpes-Maritimes to review its decision to deny aid associations access to prefabricated housing in Menton migrants arrested at the border before their return to Italy.

Ruling in summary proceedings, the court expressed “

serious doubts as to the legality of the contested decision

”, requested “

a re-examination of the access request

” and gave

the prefecture “

30 days

”.

Asked in September by Médecins du Monde (MDM) and the National Association of Border Assistance for Foreigners (Anafe) who wanted to intervene for medical, legal and administrative assistance, the prefecture refused and justified its refusal by explaining that the premises came under the common law applicable to police premises.

In its order, the court nevertheless notes that the prefecture does not dispute, in its written submissions, what MDM, Anafe and many other associations have been supporting for four years.

Since the installation of these prefabs in 2017 near the premises of the border police (PAF) in Menton, the court notes in fact, “

daily, many people are held in these premises equipped with a locking system and video surveillance, in precarious conditions, for many hours, especially at night when the Italian police station is closed, and they are unable to leave freely and obtain medical, legal or administrative assistance from associations

” .

The prefect does not dispute (...) the daily nature of these 'sheltering' practices, particularly between 7:00 p.m. and 8:00 a.m., without the possibility of regular or even occasional access to these premises being granted, in view of certain health circumstances, to provide assistance to those detained,

”underlines the court.

In 2018, the Controller General of Places of Deprivation of Liberty (CGLPL) pinned the PAF of Menton for the conditions of care for foreigners at the Franco-Italian border.
