The prefect and the rector of Corsica had referred to the administrative court at the end of May the decision of the Collectivité of Corsica to postpone the reception of students in secondary schools and high schools on the island to September.

They wanted these establishments, closed due to the coronavirus epidemic and confinement, to be able to welcome students again during the end of the school year.

The Collectivity of Corsica, which owns secondary schools (middle and high schools) and responsible for the agents responsible for their maintenance, had for its part invoked health security to justify its decision not to reopen them.

This decision was approved on May 7 by the Corsican Assembly.

By a judgment dated December 1, the administrative court, which had not been seized in summary proceedings, "

annulled this deliberation

" of the Assembly of Corsica and "

recalls that the jurisdiction entrusted by law to the Collectivity of Corsica consists of to ensure the material conditions of reception of the pupils in the middle and high schools

”.

"

It is up to the State to set the date for the reopening of these educational establishments, which contribute to the functioning of the national public education service for which it is responsible

", adds the court.

Contacted by AFP to know if it intended to appeal this decision, the Collectivité de Corse indicated that it had not yet taken a decision on the matter.
