"I can't even remember all of that," said the defendant in front of the Erdinger district court.
According to the public prosecutor's office, the Austrian (60) coerced a car driver on the A 92 towards Deggendorf near Langenpreising in June.
But because the witnesses also had gaps in their memories, the case was discontinued against a payment.
Erding / Langenpreising
- At the beginning of June this year, a Landshut family was on their way home from Erding.
The driver, a 48-year-old teacher, pulled into the left lane to overtake a couple of trucks.
While overtaking, he noticed in the rearview mirror “a car that was approaching me very quickly.
When I looked back in the rearview mirror shortly afterwards, the headlights were gone and all I could see was the hood.
I think it was ten meters behind me ”.
The teacher was traveling at around 130 km / h.
But then he couldn't switch back to the right lane.
When he had overtaken the truck, the man behind him, the defendant, swerved to the right, only to return to the left lane a little later.
That happened a few times.
"A ping-pong game," said the 48-year-old.
“I had my family in the car.
What do you do in such a situation?
Do you drive to the right and provoke an accident, or do you stay to the left? ”He stayed on the left and did not allow himself to be disturbed until the defendant overtook him on the right.
"Then it is at best an attempted coercion," noted judge Alexander Wassermann - the defendant did not achieve his goal of urging the teacher to change lanes.
The injured party could not recognize the accused.
Even his wife, who was tired and inattentive at the time, could not identify the 60-year-old.
The teacher had only memorized the license plate and given it to the police.
Also because the accused had never appeared under criminal or traffic law, Wassermann suggested that the proceedings be discontinued.
Public prosecutor Lisa Paukovic and defense attorney Katharina Pamler agreed to this idea.
The defendant now has to pay 400 euros to the Malteser relief service.
