The family of Yosef, the boy from Jaljulia who was convicted of murder on the basis of rejected evidence and his story was revealed in Walla!

NEWS, received the news this morning (Tuesday) that he will win a retrial, and excitement gripped them.

His relatives say that in fact the Supreme Court's decision has already done justice and partial correction.

Now, they are preparing for the next stage - the war for his innocence.



"It's not a stone that moves a little from the heart, it's a mountain," Yosef's uncle said in a conversation with Walla!

"You can not imagine how much we have waited for this. The very fact that they received the request for a retrial, there is already 50% or 60% justice in it. Now there is another stage left, which is difficult, but we will overcome it as well."



"The feeling is very good, and we hope for the best. Hopefully the truth will come out," two other uncles described.

This morning, Supreme Court Justice Neil Handel ruled that Yosef, who was convicted of murdering 15-year-old Amjad Shawhana from Kafr Qassem who was shot dead on a bus in 2009, will be tried again.

Handel's decision states that "the circumstances of the case before me may raise a real concern of miscarriage of justice."



The incident for which Yosef was convicted occurred near Kfar Qassem on October 8, 2009, when a bundle of ten Kalashnikov rifles, fired from an ambush, entered a bus transporting students back from school.

Shahavana was killed in the shooting, and another student - Suleiman - was seriously injured.



The boy's uncles are convinced that their nephew did not commit the act for which he was convicted, and tell of ignoring their testimonies from the day of the murder.

"My brother and I were on the same day, almost at the same time of the incident, talking to Joseph on the phone that was in his house (the landline)," they said.

"He was at home at all. We are 100% sure of that. We said that too, but they did not want to hear. The neighbor also said that she saw him at home from her window, and they did not want to hear. They sewed a bag for him."

The Public Defender's Office also welcomed the rare decision, and expressed satisfaction.

"We very gladly and with great satisfaction accepted the decision of the Supreme Court (the Honorable Justice Handel) to grant a retrial to Joseph, who has been imprisoned for more than nine years for his conviction as a minor for a murder offense," attorneys Eitan Maoz and Mor Hernick-Bloom "As the Supreme Court has been impressed, there is indeed a grave concern that his conviction for murder is a false conviction."



According to them, the request for a retrial "indicates that the conviction is based on evidence declared in parallel trial unacceptable. And not credibility due to very serious defects in the interrogation of the witnesses, which caused the existence of a serious distortion of law. "
