V-Baumarkt: The Greens' request for advice clearly fails

It was a clear decision made by the Peitingen municipal council in its meeting on Tuesday: The committee rejected the request for advice on the V-Baumarkt for the V-Baumarkt by 18: 6 votes.

The door to a referendum should thus be finally closed.

Peiting

- Another municipal council meeting, again on Tuesday it revolved around the planned new construction of the V-Baumarkt on Zeißlerweg.

After the committee had also had to declare the second referendum to be inadmissible the previous week due to formal errors, this time the question was whether the municipal council itself should bring about a referendum on the controversial project by referring to the council.

It was initiated by the Greens.

Susann Tabatabai-Schweizer described why in the meeting.

The Green Councilor recalled that the almost 1000 signatures required for a referendum had been collected twice, and most recently under the difficult conditions of the corona pandemic.

"There are a lot of citizens who want to have a say and who now cannot make use of the democratic tool of a referendum." This is exactly the chance they want to be given with a request for advice.

Green Councilor appeals to the committee

Tabatabai-Schweizer emphasized that the decision on the application was not about content-related viewpoints and also not about healing the mistakes that the applicants for the citizens' petition had made.

“We live in a country where the citizens can have a say.” Giving them this opportunity in this case is very important to her personally, said the native Iranian.

"That would be a sign of respect for the citizens." A referendum would also pacify the entire discussion about the project, which was also shown at Marienheim, recalled the Green Councilor.

"I therefore ask you to go back to yourself," she appealed to the panel.

It was Franz Seidel who was the first to speak.

He could not agree to the council request, said the BVP council, even if he himself is known to be one of the critics of the DIY store project.

A year ago, however, the majority of the municipal council decided differently when it approved the sale of the property to the investor, he recalled.

It is now much too late to petition for advice.

"What kind of signal would that be from the municipal council?"

The majority of the councils are negative

CSU councilor Uwe Enzmann also agreed.

"If you conclude contracts, you should also keep them," he said, referring to the property deal, which has already been notarized.

Herbert Salzmann (SPD) refused to accept the accusation that rejecting democracy is not enough.

After all, the municipal council is the democratic basis.

"You have all been elected here." The majority of the Peitinger want the hardware store.

"We have never been afraid to stand up for it."

Norbert Merk (CSU), meanwhile, repeated his regret that the referendum had failed.

Unfortunately, the applicants did not seek help with the administration in advance, but rather relied on a supposed savior from Munich - meaning their lawyer.

Because of this, however, one could not give up all customs, the local council had made a democratic decision, emphasized Merk.

Hermann Mödl (BVP) was torn back and forth.

He is in favor of a referendum, but also sees that the resolution of a request for a council makes it difficult for the local council to remain credible.

But there were also clear supporters of the Council request.

Christian Lory (Independent) recalled the complaints of the DIY store opponents.

A council request could create clarity for the investor here.

Marion Gillinger (ÖDP) thought that the council should leave it to the Peitingers whether they want a market of this size.

Finally, Mayor Peter Ostenrieder had the final word.

He sees the legal proceedings relaxed, he knows the legal situation.

The discussion about the construction market can be pacified if one now takes a resolution that shows that the committee is capable of acting.

A request for a council makes sense in a diffuse mood, that is not the case here, he emphasized.

There is not only a clear municipal council decision for each hardware store, but also a clear opinion among the population.

The majority of the committee saw it like the town hall chief.

The council proposal was rejected with 18: 6 votes.

Zoning plan in dry cloth

After the rejection of the request for a council, the Peitingen municipal council also made two other important decisions on the construction of new DIY stores on Tuesday.

These revolved around the necessary changes to the land use and development plan for the major project on Zeißlerweg.

In March, the committee initiated the construction control procedure.

After the first public display, the comments received from the authorities and public bodies were dealt with in June.

On Tuesday, the councils dealt with the comments received after the second interpretation.

This time, they were weighed up much faster because there were hardly any new objections.

Mayor Peter Ostenrieder sent the majority of them verbatim as in the first round of the procedure, before briefly going through the ten statements individually.

What was new was that the municipality of Burggen had meanwhile also expressed its rejection of the new building plans.

Like the other surrounding municipalities, Burggen also criticized the high space consumption and pointed to the numerous DIY stores that already existed.

Of course, this had no effect.

The statement was acknowledged with 18: 6 votes without much discussion.

In the end, the vote in the municipal council on the determination and statute resolution was just as clear.

Much to the mayor's delight: “We have come a big step further.” Ostenrieder expects the investor's building application at the beginning of 2021.
