The General Prosecutor's Office keeps the investigation open to the king emeritus despite the regularization

The Prosecutor's Office will examine the statement presented by Juan Carlos I to try to regularize his debt with the Treasury, but it will do so without abandoning the investigations that it keeps open on the alleged use by the emeritus king of credit cards linked to funds of a Mexican businessman .

This is what the Prosecutor's Office has assured this Friday in a note in which it indicates that after the meeting held by the prosecutors responsible for the investigation, the Prosecutor's Office will assess the scope of the tax declaration presented by Don Juan Carlos on December 9, “his spontaneity, veracity and completeness, within the framework of a broader investigation that will continue to be carried out by the Office of the Supreme Court Prosecutor ”.

The announcement by the Prosecutor's Office comes after it became known this Thursday that the public prosecutor informed the former head of state a few weeks ago that he had opened an investigation into the use of cards with money that businessman Allen Sanginés-Krause allegedly donated to him and Juan Carlos I had not declared to the Treasury until last Wednesday, when he presented a declaration by which he settled a debt with the treasury of 678,393 euros.

The intention of the emeritus king is to take advantage of article 305.4 of the Penal Code, which allows to regularize the fiscal situation provided that the declaration is made before the Administration or justice "files a complaint or complaint" or before the Prosecutor's Office or the judge "carry out actions that allow him to have formal knowledge of the initiation of proceedings."

The Public Ministry has doubts as to whether the statement presented by Don Juan Carlos meets that requirement, so it will study its "spontaneity", as announced in the statement made public this Friday.

The team of prosecutors led by Juan Ignacio Campos will also examine that the documentation registered by the king emeritus is "complete and truthful", the other two conditions for the situation to be considered regularized.

To do this, according to tax sources, they will have to make an exhaustive evaluation of the accounts and assets of Juan Carlos I, for which, predictably, he will ask for help from the Tax Agency and the General Directorate of Taxes of Madrid.

The step taken by the king emeritus last Wednesday does not stop, for the moment, the investigation of the Prosecutor's Office.

The Public Ministry, according to the sources consulted, will continue to study the documentation related to this case that it has been gathering in recent weeks and that will also be decisive in determining whether the statement presented now by the former head of state meets the requirements imposed the Penal Code to be exonerated from a possible tax offense.

Sources of the investigation add that there are still pending proceedings and information pending to reach the prosecution that will also be key to decide whether what was declared by Juan Carlos I coincides with what was investigated by the prosecution.
