“A referendum adding the climate to article 1 of the Constitution? Useless or dangerous ”

FIGAROVOX / TRIBUNE - According to Jean-Éric Schoettl, former Secretary General of the Constitutional Council, it is difficult to discern the interest of the referendum desired by Emmanuel Macron in order to include the environment in Article 1 of the Constitution.


Six months ago, Emmanuel Macron said he was ready to resort to a referendum, before the end of 2021, in order to adopt some of the proposals made by the 150 people drawn by lot to participate in the Citizens' Convention for the weather.

Two forms of referendum consultation had to be used a priori, depending on the subject to be dealt with: that provided for by article 89 of the Constitution, when the measures proposed by the "conventional" called for a modification of the Constitution;

or that defined in article 11 of the Constitution, for measures the implementation of which required an ordinary law.

The two referendum procedures differ on important points.

Thus, the first (article 89), unlike the second, requires a compliant vote of the two assemblies on the text before submitting it to popular suffrage. On December 14, receiving the members of the Citizen's Climate Convention , the Head of State confirmed his intention to convene
