Hungary's asylum rules violate EU law.
The European Court of Justice in Luxembourg ruled on Thursday.
The court condemned Hungary primarily for the “illegal detention” of those in need of protection in so-called transit zones and the repatriation of refugees without observing the applicable guarantees.
The ECJ largely corresponded to a lawsuit brought by the EU Commission against Hungary.
Since the height of the refugee crisis in 2015, the Brussels authority had repeatedly expressed doubts about the compatibility of the Hungarian asylum rules with EU law.
In particular, the systematic detention of people at the Hungarian-Serbian border without taking into account the guarantees contained in the Return Directive met with criticism in Brussels.
