- In his traditional look back at the year-end meeting, Mayor Thomas Holz is happy to be forgiving and a little contemplative.

Not so at the end of the 2020 election year. On May 1st, when the new municipal council took office, a “general change in dealings with one another began” in the committee.

Without naming names, but with a recognizable reference to the three SPD and Free Voters municipal councils sitting in front of him on the left in front of him, Holz complained “that scandal or barbarism were shouted during the execution of municipal council resolutions and legally binding permits, and even political consequences were demanded and criminal charges have been filed or such a complaint has been applauded ”.

The mayor made it clear that democracy is lived if, after a defeat in a vote, one “accepts the result and then does not follow up on the social and print media”.

The former amplifier office turned into a nice mess on Tuesday evening.

Already at the beginning of the meeting, the mayor had struck a sharp tone when he reiterated the outcome of the popular complaint about the former amplifier office.

The Bavarian Constitutional Court (VGH) rejected it on November 23.

"That was a success across the board for the community," stated Holz.

He is very happy about the decision, which he does not want to be understood as malicious joy.

The Weilheim architect Heiko Folkerts, who was in charge of filing the lawsuit, as an opponent of the project did not shy away from the "media dissemination of untruths, massive personal attacks and insults as well as criminal charges".

After all, Folkerts even “constructed conspiracy theories about the neutrality of the judges at the Bavarian Constitutional Court”.

"There is still justice in Bavaria"

According to Holz, the Bavarian supreme court has clearly and in detail confirmed that the municipality "did everything right" in drawing up the relevant development plan.

The municipality had neither violated the balancing requirement under construction planning law, nor had the arbitrary prohibition been violated.

Holz once again pointed out the following sentence in the VGH explanatory memorandum, which states "that the municipality has come to the conclusion that the (...) building ensemble was not a monument".

In retrospect, it is all the more incomprehensible for the mayor that some municipal councilors spoke out against the decision in June to commission a law firm to safeguard Kochler's interests.

It is thanks to the mayor's steadfastness and expertise that the community achieved this success before the Bavarian supreme court, said Johann Resenberger (CSU).

As the longest-serving councilor, he is happy "that there is still justice in Bavaria".

Now the municipality can finally start working on the big project.

Resenberger thanked not only the mayor for his “unshakable work”, but also the entire town hall team.

The CSU municipal council agreed with the mayor: "We are proud of our administration, which has received confirmation of its good work through this decision."
