A PolyU boy was arrested in Mong Kok on New Year’s Eve last year when the police dispersed the crowd and charged with possession of shears and spray paint.

The case was decided in the West Kowloon Court today (22nd). The magistrate stated that the boy was with about 20 to 30 people in black at the time and confirmed that they were not simple passersby. He was found guilty of gathering illegally and intending to destroy or damage property. The magistrate adjourned the case to January 4 and sentenced him. During the period, he asked for reports from the training center, labor camp, and rehabilitation center for Susheng. The boys had to return the sentence.

The defendant Cai Songxi (19 years old) was charged on December 31 last year at the junction of Nathan Road and Lai Chi Kok Road in Mong Kok for participating in an illegal assembly with other unknown persons and possessing a pair of cutting pliers and two spray paints.

He was also charged with one count of possessing a tool suitable for illegal use with intent to use, but was found not guilty.

The facts of the case allege that at 9 pm on the day of the incident, a number of people in black gathered on Nathan Road in Mong Kok and some people were suspected of blocking the road. When the police arrived and dispersed, they saw about 20 to 30 people in black. On the road and the flower slot in the middle of the road, the police officers stepped forward to intercept many people, including the defendant who was wearing black clothes and black trousers. The defendant was wearing a scarf, wearing labor gloves in his right hand, and holding pliers. He saw the police immediately. Turned to leave, but was subdued by police officers after escaping about 10 meters.

The magistrate pointed out that there was a large-scale illegal assembly in Mong Kok that night. Not only was the defendant in it, but his clothing and belongings were the same as those of the demonstrators. The magistrate also believed that the 20 to 30 people in black beside the defendant were definitely He was not a mere passerby, so it was inferred that the defendant was one of them and wanted to disrupt social peace by blocking roads and other acts.

In addition, there were traces of graffiti near the location where the defendant was arrested. Environmental evidence stated that the purpose of the defendant's possession of spray paint was to make graffiti at an appropriate time. Therefore, the defendant was found guilty of illegal assembly and possession of objects with intent to destroy or damage property.

The prosecution has not certified that the cutting pliers are used to restrain or wound people

However, the magistrate believed that the prosecution could not prove that the clippers in the defendant's possession were used to restrain people, wound people or sneak into the house, so they ruled that the clippers were not guilty.

The defendant's parents were harassed by the incident

The defense pleaded that the defendant had a good background and was studying physical therapy at the Hong Kong Polytechnic University. He had a promising future. He was affected by the social environment before committing this case.
