No entry to the ice rink: Bad Bayersoien is legally protected

The signs are not enough. At least not if there is legal repercussions after an accident on the ice surface. But now the Bad Bayersoien community has improved.

The signs are not enough.

At least not if there is legal repercussions after an accident on the ice surface.

But now the Bad Bayersoien community has improved.

Bad Bayersoien

- In summer it is populated by bathers who cool off in the water.

In winter, the Soier See attracts ice skating fans.

Locals as well as guests who want to swim their laps on the frozen surface or play ice hockey.

Even Mayor Gisela Kieweg likes to strap the runners to her feet.

But the winters are getting milder.

“There is no longer a sufficiently thick ice sheet,” she says.

For ten years now, the community has been putting up signs indicating that entry is prohibited.

Signs that warn of the risk of burglary and death.

Boards with unmistakable symbols.

And yet they tend to be ignored.

Now the commune is reacting.

At its last meeting of the year, the municipal council issued an ordinance (8: 2 votes).

It is valid for 20 years.

An accident that occurred in January 2020 played a role in the decision.

Four women left the signs cold.

They were skating around 80 meters from the bank when they suddenly collapsed.

A first responder attempting to save the quartet met the same fate.

In the end, everyone came back unharmed.

Administration can waive fines

The community was not prosecuted because nothing happened in the end.

“We got off well,” remarked Kieweg at the meeting, “but were advised to make a regulation.” Signs alone are not enough.

In addition, the municipality cannot regularly check and supervise whether the signs are being followed.

Unfortunately, people are becoming more and more irrational.

Mayor Gisela Kieweg

It's about nothing else than to secure yourself legally.

In order not to be liable in an emergency and to be able to calmly face possible lawsuits.

Maximilian Drexler (GUD) therefore believes the approach is the right step.

"Before the money costs us, we'd better make a prescription." Is it really necessary?

Rupert Haseidl (GUD) is a little more skeptical about the whole thing.

He advocated at least waiving the fine regulations.

But that is not possible, Kieweg clarified.

At the same time, however, it made it clear that the corresponding paragraph should not be deposited with amounts.

So there is no catalog of fines in which certain sums are assigned to a certain violation.

The administration waives the fines.

"She makes a case-by-case examination," says Kieweg when asked by the daily newspaper.

That is, it determines the amount according to the severity of the offense.

Kieweg would prefer it not to need any of that.

But "unfortunately people are becoming more and more unreasonable".

As the four women showed in January.
