The Hong Kong Government stated that the Commissioner for Labour has now further agreed in principle that all foreign domestic helper contracts that expire on or before March 31 next year can amend the employment in Item 2 of the standard employment contract with the agreement of both the employer and the foreign domestic helper. The contract period is extended by up to 3 months, and it is emphasized that the 3-month extension period should provide enough time for employers to arrange for their newly hired foreign domestic helpers to come to Hong Kong.

If the newly hired FDH cannot be arranged to come to Hong Kong within the extension period, the employer must continue to hire the current FDH and apply for contract renewal.

Foreign domestic helpers who leave early must leave Hong Kong within two weeks

In response to recent social concerns about the health risks of foreign domestic helpers staying in accommodation facilities, and to prevent foreign domestic helpers from abusing the above-mentioned flexible arrangements and frequently changing employers, the government has decided that foreign domestic helpers who terminate their employment contracts early will not be allowed to apply for extension in Hong Kong as visitors According to the current government policy, foreign domestic helpers must leave Hong Kong after completing the employment contract, or leave Hong Kong within two weeks after the termination of the employment contract, whichever is the earlier date.

Under special circumstances that require special consideration, foreign domestic helpers can apply to the Immigration Department to continue their stay in Hong Kong as a visitor.

The Immigration Department will continue to accept and expedite the processing of work visa applications from foreign domestic helpers in Hong Kong. At the same time, the Department will further prevent foreign domestic helpers from "skiing out of work" and will continue to review applicants in detail.
