Separatism bill: the government tabled an amendment on social networks

"When the operator does not comply with the formal notice sent to him, the Superior Audiovisual Council can (...) pronounce a financial penalty", indicates the text, which is inspired by the Avia law .


Apology for crimes, provocation to discrimination, hatred, violence: the government tabled an amendment on Friday that aims to fight against illegal content on social networks, as part of its bill against separatism, learned from AFP on Saturday January 16.

This amendment aims to regulate the moderation of illegal content on social networks and search engines.

The amendment provides in particular that the operators of the platforms "

implement procedures and human and technological resources proportionate

", allowing in particular "

to inform the judicial or administrative authorities as soon as possible of the actions they have implemented

" following the injunctions issued by the latter.

An amendment inspired by the Avia law

This amendment is partially inspired by the bill against online hatred, which was brought by LREM deputy Laetitia Avia, largely censored by the Constitutional Council.

The part included in this amendment had been censored not on the fund but by domino effect of the censorship of other articles of the law, reminded AFP a source in the office of the Secretary of State for Digital.

This text aims to anticipate the implementation of a European regulation on digital services (“

Digital Services Act

”, DSA), the draft of which was presented in mid-December by European Commissioner Thierry Breton.

It aims to make all intermediaries accountable, but even more so the largest platforms which will have to have the means to moderate the content they host and cooperate with the authorities.

" the provisions of this regulation in domestic law, "

the objective being to have a flexible transition between what we are going to put in place and the regulation

", of which negotiations at European level risk taking an certain time "

These provisions are transitional and will be extinguished when this European regulation is implemented

", adds one to the Secretary of State.

When the operator does not comply with the formal notice sent to him, the Superior Audiovisual Council may (...) pronounce a financial penalty the amount of which takes into account the seriousness of the breaches as well as, the if applicable, their reiterated nature, without being able to exceed 20 million euros or 6% of the total worldwide annual turnover of the previous financial year, whichever is greater

”, indicates the text.
