For weeks the same confession could be heard from politics: there will be no compulsory vaccination.
Really not!
But it was only a matter of time before someone broke away.
And it is no small matter that this someone is Markus Söder.
Many voters would like the Bavarian Prime Minister to become Federal Chancellor in autumn - incidentally, he seems to want that too.
The public debate is now coming to a head on the question of whether nurses should be obliged to vaccinate.
Söder says it's a good idea.
According to a SPIEGEL survey, a majority of respondents agree with him.
But it's not a good idea.
From a legal point of view, compulsory vaccination is an interference with fundamental rights, depending on the point of view and source, as a "moderate" interference or, as the former Federal Constitutional Judge Hans-Jürgen Papier sees it, as "more serious".
Paper refers to Article 2, Paragraph 2 of the Basic Law, which protects physical integrity and the right to self-determination.
"It is always a question of the proportionality of the severity of the intervention and the associated benefit for the general public," he says.
“I would advise you to be careful about singling out certain groups of people.
If the people to be cared for are largely vaccinated, on the one hand the caregivers are not at greater risk, and on the other hand the risk of infection they emanate is no greater than for any other non-vaccinated person. "
