Privacy Commissioner Chung Lai-ling attended the meeting of the Legislative Council Committee on Constitutional Affairs today (18th) to give a briefing on last year's work.

Zhong Liling pointed out that the Privacy Office handled 1,198 complaints related to the "beginning" in 2020, involving police officers and citizens.

Chen Jianbo questioned the government's insufficient crackdown before the "Privacy Ordinance" was revised.

Zhong Liling pointed out that the PCPD will take the initiative to attack when it discovers the bottom line. As of December 31, 2020, the PCPD has sent 1,461 suspected violations of Article 64 of the Privacy Ordinance to the police for criminal investigation and Consider prosecution.

According to the police, a total of 17 persons were arrested and suspected of violating section 64 of the Privacy Ordinance. It also alleged that the latest defendant was convicted of violating section 64(2) of the Privacy Ordinance in the District Court on October 9, 2020. Articles of disclosure of personal data obtained without the consent of the data user, together with other offences, were convicted and sentenced to 18 months’ imprisonment. Together with other convictions, a total of two years’ imprisonment was considered sufficient deterrent.

Committee Chairman Zhou Hao Ting urged the government to submit a proposal for legislative amendments to the Privacy Ordinance as soon as possible, in order to strengthen the crackdown on the bottom line.

Zhou Haoding stated that the authorities have successfully prosecuted one case of infringement of the Privacy Ordinance, and the remaining cases can only be prosecuted by contempt of court injunctions. At the time of the emergence, the Privacy Ordinance was still insufficient in combating the original crimes. It is necessary to amend the law as soon as possible so that the current privacy regulations can keep up with the times and adapt to today's changing network world conditions.
