The spontaneous decision to visit his parents and sister in Plattling cost a banker his professional existence.

Because the Munich man sat behind the wheel with 2.51 per thousand alcohol in his blood and was promptly involved in a serious accident on the A 92.

Langenpreising / Erding - The 38-year-old had received a penalty warrant with driver's license revoked only a few days before after he had gotten into a traffic control in Munich with three per thousand.

The Erding District Court gave the sobering receipt: eight months in prison on probation, 2500 euros to an addiction support facility, three years of absolute alcohol ban and one and a half years of driving license withdrawal.

The disaster began on the evening of July 31, 2020.

The banker, who lost his job because of the incident, celebrated a birthday with friends.

Not only during the party was mugs lively.

The next morning he cheerfully poured three wheat beers over the morning pint.

Then he got a call from his parents.

The sister from the Emsland was a surprise visit, whether he didn't want to see her.

The 38-year-old wanted that, got into his company BMW and drove off in Munich.

And not only when it is absolutely unfit to drive - it starts at 1.1 per mille - but obviously quite brisk too.

Because on the A 92 in the direction of Deggendorf, the Munich driver recognized too late at a speed of 170 km / h that a Ford Transit had switched to the left lane to overtake Langenpreising.

The defendant tried to evade, but his BMW rammed the rear of the van, both vehicles hit the crash barriers violently.

The 49-year-old opponent in the accident broke his rib and suffered a whiplash.

It was not possible to clarify whether the man had blinked before the departure or had suddenly changed lanes.

That is why prosecutor Johannes Hauber dropped the charge of negligent traffic hazard.

As a result, the assault was off the table.

But two weighty points of the indictment remained: the drunkenness in traffic, which Hauber even assessed as intentional and thus aggravating the penalty because of the high level of alcoholism, and driving without a driver's license.

The now unemployed bank clerk was remorseful and confessed.

He also admitted that he was alcoholic at the time.

“But I've been dry since the accident, that was the last warning shot.” He also joined Alcoholics Anonymous.

A young officer from the Freising traffic police remembered "a serious accident".

In the beginning it wasn't that easy to get an overview.

The BMW driver seemed clearly drunk.

The transporter driver even said: "It was much faster than 200 km / h."

Prosecutor Hauber appreciated the confession, but called it aggravating the fact that the Munich man had just had his driver's license withdrawn and a penalty order served.

He requested one year and three months probation.

Defense attorney Dr.

Martin Paringer only recognized a drunk drive without a license.

Therefore, he held a fine of 110 daily rates of 55 euros each as sufficient - a total of 6050 euros.

Judge Andreas Wassermann sentenced the 38-year-old to eight months in prison, suspended for three years.

He referred not only to the high level of alcoholism and the second drunk driving within a short time, but also to the fact that the Munich native wanted to drive 120 kilometers in this condition - and at high speed on the autobahn.

"You should have known you were unfit to drive," he said.
