No more clothes in the supermarket?

Many retailers such as shoe or electronics stores have closed due to the current Corona measures.

Large supermarkets still sell these goods.

That is not allowed.

You now have to cordon off the non-food departments.

District - Residents in the Weilheim-Schongau district keep asking why supermarkets like Real or Kaufland are also allowed to sell goods such as clothing, shoes or electrical goods.

One thing is certain: you are actually not allowed to.

According to the Infection Protection Measures Ordinance of the Free State of Bavaria, mixed farms can sell their entire range if more than 50 percent are within the permitted range.

But this regulation does not apply to large companies: "In the case of large-scale retail operations such as hypermarkets, hypermarkets and large drugstores, the mixed operation regulation does not apply if non-permitted product ranges are offered in separate, well-defined departments - such as a separate floor - of the company.

These departments must be closed ”, writes the Bavarian State Ministry for Economic Affairs, Regional Development and Energy on its website under the FAQ - a summary of the answers to frequently asked questions.

The retailers in the Weilheim-Schongau district recently complained about the regular confusion.

Real-Markt in Weilheim: "There are no adjustments to the range for us"

Some companies apparently do not apply this regulation to themselves. The statement of the Real press office at least suggests this: “We operate all of our locations in accordance with the current Corona state ordinance and FAQ.

This does not result in any adjustments to the range for our store in Weilheim, ”said a spokesman last week.

But why is it that large companies like Real have been allowed to sell the non-food range so far?

The respective public order offices are responsible for the closure order, in the case of Weilheim-Schongau the district order office of the district office.

As head Helmut Stork said on Friday, he and his colleague are “just about to find out”.

They have already contacted the Real store in Weilheim.

"The manager has assured us that he will start locking up immediately," said Stork.

District regulatory office Weilheim-Schongau cannot control every market

And what about the other shops in the district?

“We cannot control every market.

We respond to hints, ”explained the district regulatory authority head.

The notice was received last week for the Real market in Weilheim.

The Müller drugstores in Weilheim and Schongau as well as Kaufland in Peißenberg will also be contacted and advised to cordon off their non-food departments.

This arrangement could also affect the V stores in Schongau and Peiting.

“So far we have only cordoned off the hardware store,” explains Nicole Schwert, manager of the V-Markt in Schongau.

As far as you know, it is the same in Peiting.

After such a cordon has been ordered, the district authority controls the correct implementation, said Stork.

In the case of the Real market, the time has come on Monday.

However, a judgment by the Augsburg Administrative Court on a similar case in Kempten could overturn the sales ban (see below).

Decision of the Augsburg Administrative Court

The regulation that large supermarkets and drugstores have to cordon off their non-food departments was overturned by the Augsburg administrative court in Kempten.

Since Thursday it has been in Kempten that household goods or electrical items can be sold again.

According to a court spokesman, the Infection Protection Measures Ordinance allows the sale of goods if they do not “go beyond the usual range of the respective shop”.

And with it the sale of items that are not food.

However, the decision is not yet legally binding.

The city of Kempten announced, however, that it would not file a complaint.

It is also unclear whether the decision also applies to the Weilheim-Schongau district and thus to the cordoning off of the departments in Real-Markt in Weilheim.

At the time of publication, this could not be researched.
