Drowning in Saint-Cyr: the prosecution does not appeal

2021-01-26T11:04:54.018Z

The three convictions and the four acquittals pronounced by the criminal court of Rennes on January 14 are now final, to the chagrin of the family of Jallal Hami, who died in October 2012.

"S

candalized"

by the outcome of the trial of seven soldiers or ex-soldiers for the "manslaughter" of his brother Jallal, Rachid Hami had confided to

Figaro in

mid-January: "

I expect the prosecutor to appeal "

.

His wish did not come true, however.

The ten-day legal deadline has passed, and neither the Rennes prosecutor Philippe Astruc nor the convicted persons appealed against the decision of the Rennes criminal court, which therefore became final.

On January 14, the judges had indeed sentenced to terms ranging from six to eight months in prison suspended two former students and a former supervisor of the special military school (ESM) of Saint-Cyr, the establishment that trains the future officers of the Army.

They had, however, released four other defendants, two former students and two former supervisors of the same school.

"A point of balance"

"

It can be observed that the decision of the court, in that it is partly far from the expectations of both of the defendants who pleaded the acquittal, that of the demands of the public prosecutor, not fully satisfied, as of the positioning of the civil party , undoubtedly constitutes a point of balance proposed to constitute an adapted judicial response.

Under these conditions, the public prosecutor decided not to appeal this decision,

”underlined the Rennes prosecutor in a press release.

"It is a very bitter and painful outcome for the family of Jallal Hami, both legally and personally,

" responded Jean-Guillaume Le Mintier, lawyer for the Hami family, to Le

Figaro

.

The relatives of the young man who died "

harbored a lot of hope in justice and in this remedy which seemed obvious to them in view of the excessively derisory quantum of the sentences handed down, the three exemptions from registration in Bulletin No. 2 granted by the court and four releases "

Only one defendant had pleaded guilty

The seven soldiers or former soldiers appeared in court from November 23 to 27, 2020 for "manslaughter".

Six of them had pleaded for acquittal, arguing that no

"serious fault"

had been committed.

Only the president of the promotion of second year - the "father system" - had pleaded guilty, considering himself responsible

"criminally and morally"

for the death of Jallal Hami.

During the night of October 29 to 30, 2012, the 24-year-old young man drowned during a workshop organized by second-year students as part of "bahutage", the period of "transmission of values" to first year students.

Equipped with fatigues, helmets and rangers, the cadets had to cross a pond, in the dark, for more than forty meters, in deep and very cold water.
