Erding - The amendment to the Bavarian building regulations will come into force in a week.

It should enable faster, larger and denser building.

Many municipalities are now issuing statutes in lightning-fast actions in order to overturn the new minimum spacing area rule.

Because one innovation now only provides for 0.4 instead of 1.0 H - that is, a ten meter high house only has to be four meters away from its neighbors, rather than ten meters as before.

The city of Erding is taking a different route.

Mayor Max Gotz and town hall lawyer Andreas Erhard reject such a statute.

“We generally regulate new development areas via development plans.

We can set legally binding intervals in these, ”says Gotz in an interview with our newspaper.

He thus regards a large part of the new building projects as covered.

"There are special rules in the city center anyway," says Gotz.

Here, for historical reasons, houses would often extend to the property line.

In addition, there are the strict rules of monument protection.

Last but not least, the parking space statutes could prove to be regulative - especially in densely built-up areas.

"If the city council does not approve an exemption from these statutes, this is a limit on the volume," said the mayor.

The amendment could only come into effect for new buildings on the green field, where there is no development plan.

Gotz looks forward to this calmly: "Because of the high land prices, what is possible is already being exhausted."

The 1.0 hour rule is therefore by no means applicable everywhere, even without the new building regulations.

In his opinion, the 0.4-hour amendment will lead to “attempts to build even more upwards”.

The OB sees this critically and addresses, among other things, the shading and the construction of ventilation aisles, especially in cities.

And in the case of replacement buildings, existing protection applies anyway.

When it comes to elevation development, one shouldn't ignore the townscape.

A skyscraper with a height of 27 meters is planned in the Thermengarten-Süd.

“More is simply not possible.” Gotz believes that three-story buildings (“E + 2”) can also be built on the outskirts.

“Something will certainly change in the rural communities, too,” he is convinced.

Basically, Gotz is critical of the new building regulations and accuses the state parliament of "technical errors".

"You listened to critics too quickly." For example, the lack of approval for loft extensions will mean "that the roof landscapes will change seriously and the intimacy between neighbors will suffer".

In addition, the parking pressure in settlements will increase considerably - and with it the anticipated annoyance.

Gotz knows that many are also happy about the fictitious permit, according to which a building application is automatically considered approved if it is not approved within three months.

In his opinion, this regulation could prove to be a shot in the knee.

"About 85 percent of the building applications received here are incomplete," he reports, "so far there has often been lively contact between the building applicant and the building authority".

Because you now have to decide more quickly, "we can no longer provide this important consulting service," he announced.

The result: "We will simply have to reject incomplete applications."

And Gotz accuses the state parliament of another weaving error: “Who is liable if documents are really forgotten?
