In response to a question from the Legislative Council today (27th), the Office of the Privacy Commissioner stated that it has received a preliminary response from WhatsApp, and will contact Facebook for further details and request more details to the public to clarify concerns.

This time, the new clauses are exempted in the United Kingdom and the European Union. This is because it is related to better privacy protection laws in the country.

The Commissioner’s Office stated that it is actively communicating with Facebook representatives and there is not enough information to comment at this stage. However, it mentioned that the EU has implemented the General Data Protection Regulation and will consider issuing guidelines on privacy issues that citizens should pay attention to when using social platforms.

Recently, the communication software Whatsapp has changed its terms of use on a large scale, transferring user information to the parent company facebook for use.

The DAB submitted a petition letter, urging the Office of the Privacy Commissioner for Personal Data to follow up and review whether the amendments violated the Hong Kong Privacy Ordinance.

The DAB Ge Peifan put forward a written question to the Constitutional and Mainland Affairs Bureau, asking whether the Bureau knows whether the Office of the Privacy Commissioner for Personal Data has discovered that the new clause violates the Personal Data (Privacy) Ordinance (Chapter 486) and related Codes and guidelines; whether the Office has received a reply; and whether the privacy laws of the United Kingdom and the European Union provide better protection, etc.

After consulting the Office of the Privacy Commissioner for Personal Data, the Constitutional and Mainland Affairs Bureau replied that the Office had written to Facebook America Headquarters earlier and actively communicated with its representatives to put forward four suggestions. Facebook announced on January 15, 2021 , Will require users to accept the new terms of use and privacy policy from February 8th to May 15th, and will further provide users with more information and explanations.
