The Haifa District Attorney's Office today (Wednesday) filed an indictment in the city district court against Amir Dalaika, a 24-year-old resident of Basmat Tivon, for causing injury to a police officer, drunk driving and interfering with a police officer in the performance of his duties.

This, during the incident in the Halisa neighborhood in which his friend, Bashar Zubidat, 19, who was shot dead by a police officer during a chase at the beginning of the tight quarantine about three weeks ago, was killed.

Their friend, who owns the vehicle known as AA in the indictment,

unharmed, was arrested the day after the incident but was eventually released.

Dalicha is accused of driving while intoxicated in his friend's toy car, and when he spotted a checkpoint set up by police he tried to escape, hitting one of the officers. During the escape attempt, one of the policemen shot at the vehicle and hit the head of Zubidat, who died of his wounds two days later.According



to the indictment, on the night of the incident, just before midnight between January 8 and 9, when the tight closure took effect, the three drove from Basmat Tivon During the trip, Dalaika and the owner of the car changed places so that Dalaika drove the car as a new driver while intoxicated, and AA was sitting in the back seat.



About two hours earlier, ahead of the closure, police and inspectors from the Haifa municipality set up a checkpoint to enforce the corona regulations, at the corner of Yosef Wiener and Isfiya streets, near the large mosque in the Halisa neighborhood.

The vehicle in which the three were traveling reached the checkpoint from the direction of Isfiya Street.

Twelve people manned the checkpoint - eight policemen stood in uniform and with them four municipal inspectors.

According to the indictment, and in parallel with documentation from a security camera, which was released last week, Dalaika noticed at the checkpoint, stopped the vehicle, engaged reverse gear, started speeding backwards and tried to make a U-turn towards Gush Etzion Street in order to escape from the police.



A policeman and a policewoman who were in one of the vehicles noticed the vehicle and started driving fast with the vehicle in its direction, in order to block it.

The policeman who was driving the car clung to the front of the vehicle and partially blocked it.

According to the indictment, at this point and when the vehicle stopped, the policeman opened the driver's door in the car with the intention of getting out of it, but then Dalika opened with an accelerated drive towards the car and the policeman, hitting the front of the car with the half-open door closed on the policeman's leg.



Then, the vehicle in which the three were traveling accelerated again, collided head-on with a car and hit a parked vehicle with its right side.

All this in order to break free from the blockage of the mobile, as the vehicle continued to drive in the direction of the traffic circle at the corner of Isfiya and Yosef Wiener streets.



The other policemen and inspectors who were at the checkpoint noticed what was happening and heard the policeman's cries and started running towards the vehicle and the car.

According to the indictment, Dalaika noticed them, continued his escape, tried to hit the policemen and inspectors who ran towards him, risked their lives and forced them to move aside to escape being hit by the vehicle.

Some of the policemen fired at the vehicle and one of the bullets hit Bashar Zubidat's head, fatally injuring him.

The vehicle continued to flee quickly, with the police chasing it, but it managed to escape.

A short time later, the vehicle was located about a kilometer and a half from the scene of the incident, on Rabbi Yosef Mashash Street in the nearby Neve Ganim neighborhood, abandoned by its occupants, except for Zubidat, who was lying injured in the front passenger seat.

Many policemen arrived at the scene, a mobile forensic laboratory, as well as Haifa Station Commander, Deputy Chief of Staff Amir Goldstein and Ein Levy Kahana, head of the Police Investigations Branch (DIP).



With the help of neighbors, police located Dalicha hiding among vehicles in a nearby parking lot on Neve Ganim The indictment states that when asked about his actions at the place, he replied that he was with a friend who lives nearby. He was arrested there and has remained under arrest ever since.



Zubidat was rushed by MDA staff to Rambam Hospital in Haifa, where he was pronounced dead two days later. Tivon, when at the end and in the days that followed, angry demonstrations were held at the entrance to the village against the police for the shooting in Zubidat, and it seems that the anger about this is still evident in the locality.

AA, the owner of the vehicle, turned himself in to the police after a day. He and Dalaika were interrogated separately while each dealt with the charge against the other. Eventually, with the help of Instagram videos taken by the three during the evening, he presented to court attorney Tomer Naveh, who represented "I, with the help of video surveillance camera of a gas station that caught the police, he was released.



Dlaich prosecuted for offenses of tampering with serious intent, damage to maliciously obstructing policemen and drunken driving without a valid license and without insurance. the prosecution placed 70 witnesses, including 39 policemen, who are expected to testify at the trial.



Since the night of the incident, an investigation has been underway in the Department of Police Investigations (DIP) in the Ministry of Justice.

The prosecutor, Adv. Yossi Gimpel of the Haifa District Attorney's Office, is requesting that the detention of Amir Dalaika be extended until the end of the legal proceedings against him.

Attorney Rania Saruji, who is representing him on behalf of the Public Defender's Office, will petition for his release.

Meanwhile, in the coming days she is expected to study the evidence in the police investigation file and she also demands to receive the investigation materials in the DIP file.
